Blockchains and Competition

Abstract:

Diplomová práce přináší ucelený pohled na vztah mezi blockchainem a hospodářskou soutěží, poskytuje přehled o možnostech a výzvách tohoto propojení a navrhuje některá řešení pro efektivní využití blockchainu v rámci hospodářské soutěže. V úvodních kapitolách je představena definice a popis blockchainu včetně jeho funkcionalit, praktického využití, výhod a nevýhod. Následující kapitoly se poté zaměřují na konkrétní vztah mezi blockchainem a hospodářskou soutěží. Práce blíže vymezuje základní subjekty na blockchainu v roli soutěžitelů, analyzuje některé aspekty relevantního trhu a specifické určování relevantního trhu na blockchainu nebo zkoumá možný vliv blockchainu na dominantní postavení podniků a na výkon koluzivních jednání. V závěrečných kapitolách práce navrhuje možná regulatorní řešení, diskutuje možné využití blockchainu v rámci efektivního výkonu hospodářské soutěže ve státní správě a krátce rozvádí problematiku blockchainu, spotřebitelského práva a nekalé soutěže.

Abstract:

The thesis provides a comprehensive view of the relationship between blockchain and competition, provides an overview of the opportunities and challenges of this link and proposes some solutions for the effective use of blockchain in competition. The introductory chapters provide a predefinition and description of blockchain, including its functionalities, practical applications, advantages and disadvantages. The following chapters then focus on the specific relationship between blockchain and competition. The thesis further defines the main actors on the blockchain in the role of competitors, analyses some aspects of the relevant market and the specific determination of the relevant market on the blockchain or examines the possible impact of the blockchain on the dominance of firms and the exercise of collusive behaviour. In the concluding chapters, the thesis proposes possible regulatory solutions, discusses the possible use of blockchain in the context of the effective exercise of competition in government and briefly elaborates on the issues of blockchain, consumer law and unfair competition.
