Comparison of legislative, accounting and tax aspects of housing cooperative and homeowners association

Abstract:

Cílem bakalářské práce je na základě komparace legislativních, účetních a daňových aspektů vyhodnotit jednotlivé formy bydlení. Ke zpracování bakalářské práce jsou použity aktuálně platné právní předpisy dopadající na danou problematiku, a to zejména občanský zákoník, který řeší bytové spoluvlastnictví a zákon o obchodních korporacích, jež má dopad na bytová družstva. V úvodní části jsou vysvětleny základní pojmy a nastíněny rozdíly mezi subjekty odpovědnými za správu domu. V další části jsou zachyceny a porovnány legislativní, účetní a daňové aspekty vztahující se jak k vlastnictví bytových jednotek, tak k subjektům odpovědným za správu domu. Následně je na základě komparace provedeno vyhodnocení jednotlivých forem bydlení s ohledem na jejich vlastnickou strukturu, kdy bylo mimo jiné zjištěno, že je-li důvodem pořízení bytu zajištění bytových potřeb pořizovatele, družstevní forma bydlení by mohla být vhodnou variantou, je-li však cílem zhodnocení volných prostředků formou pronájmu, osobní vlastnictví se může jevit jako zajímavější.

Abstract:

The aim of the bachelor thesis is based on the comparison of legislative, accounting and tax aspects to evaluate individual forms of housing. The current valid legal regulations affecting the given issue are used for the elaboration of the bachelor's thesis, especially the Civil Code, which addresses housing co-ownership and the law on business corporations, which has an impact on housing cooperatives. The introductory part explains the basic concepts and outlines the differences between the entities responsible for the administration of the house. The next part captures and compares the legislative, accounting and tax aspects related to both the ownership of housing units and the entities responsible for house management. Subsequently, based on the comparison, the evaluation of individual forms of housing is performed with regard to their ownership structure, while it was found, among other things, that if the reason for acquiring an apartment is to secure the housing needs of the acquirer, a cooperative form of housing could be a suitable option, but if the goal is to increase the free funds in the form of rent, personal ownership may seem more interesting.
