Abstract:

Bakalářská práce na téma praní špinavých peněz se danou problematikou zabývá velmi široce. Od samotného vymezení pojmu „špinavé peníze“ a základní charakteristiky boje proti jednání nazývanému „praní špinavých peněz“, tak jak je tento boj organizován a na jakých principech je založen v jednotlivých státech, se pak následně zabývá legislativní úpravou tohoto boje v České republice. Tato část věnovaná legislativní úpravě uvedené oblasti pak zahrnuje mezinárodní instrumenty v boji proti praní špinavých peněz, které jsou její neopomenutelnou součástí, neboť z nich následně vychází také národní právní úprava. V rámci kapitoly pojednávající o národní legislativě, kterou je upraven boj proti legalizaci výnosů z trestné činnosti je pak rozvedena jak mimotrestní právní úprava tak úprava trestněprávní. Principy systému boje proti „praní špinavých peněz“ jsou pak v samostatné kapitole rozvedeny tak, jak je tento boj organizován v České republice. Jsou zde vymezeny úkoly finanční zpravodajské jednotky a samozřejmě také úkoly policejních útvarů v rámci dané problematiky. Následně je obsahem popis vlastního procesu „praní špinavých peněz“ včetně jeho znaků společných pro jeho jednotlivé fáze. V téže kapitole se práce pokouší nastínit metody „pracího“ procesu, což však vzhledem k jejich postupnému zdokonalování a rafinovanosti není zcela možné, a tak je o nich pojednáno pouze obecně ve vztahu k jednotlivým institucím, jejichž prostřednictvím se mohou realizovat. Další kapitola se zabývá problematikou včasného zjištění indikátorů podezřelých obchodů, která úzce souvisí s úspěšností boje proti trestné činnosti spojenou s legalizací nelegálních zisků a dále pojednává o problematice zjištění zdrojového trestného činu, jehož zadokumentování a prokázání spojitosti s „pranými“ penězi je dle naší platné právní úpravy předpokladem k trestnosti takového jednání spočívajícího v „praní špinavých peněz“. V závěrečné kapitole je pak zhodnocena účinnost nástrojů platné právní úpravy v oblasti boje proti „praní špinavých peněz“ a samozřejmě obsahuje i vlastní úvahy a názory o možné budoucí právní úpravě této problematiky. Cílem práce tedy nebylo a není podat k dané problematice zcela vyčerpávající výklad, což není ani možné vzhledem k obsáhlosti tématu „praní špinavých peněz“.

Abstract:

This Bachelor work with the theme „Money laundering“ deals very widely with the given problems. First of all it qualifies the term „dirty money“ and characterizes the fight against the activity called „money laundering“. It deals with the ways how this fight is organized and on which principles it is based in various countries and then it speaks about the legislative arrangements of this fight in the Czech Republic. This part includes the international instruments in the fight against „ money laundering“ as they are its imprescriptible komponent. The national legal adjustements come out of them. In the chapter dealing with national legislation which talks about the fight against legalizing profits from criminal activities the retributive and nonretributive measures are explained. The independent chapter deals with the principles and the system of the fight against the legalization of profits from criminal activities in the Czech Rebublic. The tasks of the financial intelligence unit and the police formations are specified here, too. Following text describes the proces of „money laundering“ itself including the common characteristic features for single phases. The same chapter tries to show methods of the laundering process which is very difficult thanks to sheir gradual improving and sophistication. That is why it can be talked about only generally. The next chapter handles the problems of timely discoveries of the indicators of dubious trades which is narrowly connected with the success in the fight against the criminal activities. Especially when it is in the connection with legalizing illegal incomes it can be supposed such activity is in the context with „money laundering. The closing chapter evaluates the effectioness of the contemporary laws in the field of the fight against the legalization of profits from criminal activities and it also naturally contains my own opinions and thoughts about the possible future legal improvements. The aim of this work was not and is not to bring the detailed explanation which is not possible with regard to the comprehensiveness of the given theme. My intention was to give the general view and basic information about the problems of „money laundering“.
