Administrative offenses in Financial Markets

Abstract:

Tato diplomová práce pojednává o správních deliktech na českém finančním trhu. Jejím stěžejním zaměřením není pouze popis jednotlivých správních deliktů ale především komparace mezi postupy vůči jednotlivým sektorům finančního trhu v České republice a to zejména v souvislosti s integrací dozoru do České národní banky, která byla uskutečněna v roce 2006. Snahou je poukázat na některé neopodstatněné rozdíly v postupech a metodikách v oblasti správních deliktů, které vznikly v důsledku odlišného vývoje dozorů nad jednotlivými sektory českého finančního trhu v průběhu posledních dvou desetiletí. Na závěr práce je navíc uvedena relativně stručná analýza postupů některých zahraničních orgánů dozoru.

Abstract:

This thesis deals with administrative offenses in the Czech financial market. Its core focus is not only a description of various administrative offenses but also a comparison between practices toward different sectors of financial markets in the Czech Republic and especially in relation to the integration of supervision into the Czech National Bank, which was realized in 2006. The aim is to highlight some unsubstantiated differences in procedures and methodologies in the field of administrative offenses, which arose as a result of the different development of supervision of sectors of the Czech financial market during the past two decades. Finally, the work is given a relatively brief analysis of some procedures of foreign supervisory authorities.
