Abstract:

HARVANOVÁ, Katarína: Custody in the Code of Criminal Procedure. [Bachelor´s Thesis]. Bankovní institut vysoká škola Praha, Foreign University in Banská Bystrica. Department of Law and Social Sience. Tutor: Mag. Mgr. Marek Para. Defended in: 2012. Pages: 53. The Bachelor´s Thesis: „Custody in the Code of Criminal Procedure “ deals with the institute of custody in the context of the Law No. 301/2005 Coll., Code of Criminal Procedure, and other related legal regulations. The objective of the Thesis was to provide complex description of the custody, focused on the individual reasons for custody, the procedure of deciding on custody, and the execution of custody in penitentiary institutions. Chapter one of the Thesis explains the essence of the custody as a seizure precaution which significantly affects the rights and freedoms of the accused person, and also presents the purposes for custody. The next chapter of the Thesis describes the individual types of custody, along with the reasons for custody. Attention is paid also to the special types of custody connected with extradition procedure, i.e. extradition of persons to foreign counties. The core of the Thesis contains the analysis of individual decisions on custody, and also an appeal against such decision, which is named “complaint”. Chapter four explains the periods of durations of the custody, the exceptions from such periods, and the methods of calculation of the duration of the given periods. Chapter five deals with orders of the escape and preventive custody issued by the relevant bodies. Chapter six deals with execution of the custody and describes in detail the individual rights and obligations of the accused person in the custody. The last chapter of the Thesis contains a brief description of the liability for any damage resulting from a decision on custody.

Vedúci práce: Mag. Mgr. Marek Para. Rok obhajoby: 2012. Počet strán: 53. Bakalárska práca „Väzba v Trestnom poriadku“ sa zaoberá inštitútom väzby v kontexte právnej úpravy zákona č. 301/2005 Z.z. Trestný poriadok a iných súvisiacich právnych predpisov. Cieľom práce bolo komplexné rozpracovanie problematiky väzby s dôrazom na jednotlivé väzobné dôvody, procesný postup rozhodovania o väzbe či samotný výkon väzby v ústavoch na výkon väzby. Prvá kapitola práce objasňuje podstatu väzby ako zaisťovacieho opatrenia, ktoré významným spôsobom zasahuje do práv a slobôd obvineného a taktiež naznačuje čo je účelom väzby. V nasledujúcej kapitole sa práca zameriava na jednotlivé druhy väzby, ktoré sa zároveň prelínajú s väzobnými dôvodmi. Pozornosť je venovaná tiež osobitným druhom väzby súvisiacim s extradičným konaním, a teda vydávaním osôb do cudziny. V jadre práce sú analyzované jednotlivé rozhodnutia o väzbe a tiež opravný prostriedok voči týmto rozhodnutiam, ktorým je sťažnosť. V štvrtej kapitole sú objasnené lehoty na trvanie väzby ako aj výnimky z týchto lehôt či spôsob samotného počítania lehôt. Nahradenie útekovej a preventívnej väzby niektorým z na to určených prostriedkov rozpracúva piata kapitola práce týkajúca sa nahradenia väzby. Šiesta kapitola obsahuje výkon väzby a podrobne popisuje aj jednotlivé práva a povinnosti obvineného vo výkone väzby. Posledná kapitola práce v krátkosti pojednáva o zodpovednosti za škodu spôsobenú rozhodnutím o väzbe.
