The Role of the Public Prosecutor in Criminal Proceedings

Abstract:

Tato diplomová práce pojednává o roli státního zástupce v trestním řízení, jakožto orgánu veřejné moci, který jménem společnosti a ve veřejném zájmu zajišťuje uplatňování práva v případech, kdy došlo k protiprávnímu jednání směřujícímu proti právem chráněnému zájmu. Diplomová práce je rozdělena do šesti kapitol, v rámci nichž dojde k zhodnocení současné právní úpravy regulující činnost státních zástupců, vymezení ústavněprávní pozice státního zastupitelství a s tím spojené otázky nezávislosti, k popsání organizačního uspořádání soustavy státního zastupitelství a k popsání změn v postavení státního zástupce v dílčích stadiích trestního řízení včetně vymezení jednotlivých oprávnění, kterými v průběhu celého trestního řízení státní zástupce disponuje. Cílem diplomové práce je přinést podstatné informace potřebné pro pochopení této, do jisté míry, složité oblasti trestního práva, přiblížit činnost státního zastupitelství v justičním systému, detailněji rozebrat aspekty postavení a působnosti státních zástupců v jednotlivých stadiích trestního řízení, a v neposlední řadě zmínit možné koncepční změny fungování státního zastupitelství.

Abstract:

This diploma thesis deals with the role of the public prosecutor in criminal proceedings, as a public authority which, on behalf of society and in the public interest, ensures the application of the law in cases where there has been an infringement directed against a legally protected interest. The diploma thesis is divided into six chapters, which will include an assessment of the current legislation regulating the activities of public prosecutors, a definition of the constitutional position of the Public Prosecutor's Office and the related issues of independence, a description of the organisational structure of the public prosecution and a description of the changes in the position of the public prosecutor in particular stages of the criminal proceedings, including a definition of the individual competencies that the prosecutor has throughout the criminal proceedings. The aim of the diploma thesis is to provide the essential information necessary for understanding this problematic area of criminal law, to present the activities of the Public Prosecutor's Office in the judicial system, to analyse in more detail the aspects of the position and competence of public prosecutors in the individual stages of criminal proceedings, and last but not least to mention possible conceptual changes in the functioning of the public prosecutor's office.
