The Principle of Subsidiarity and the Protection of Fundamental Rights in the European Union

Abstract:

Princip subsidiarity je součástí právního systému Evropské unie od počátku devadesátých let minulého století. V současné době jej lze nalézt v článku 5 odst. 3 Smlouvy o Evropské unii. Toto pravidlo pomáhá určovat, kdo je v případě tzv. sdílené pravomoci oprávněn jednat – zda unie nebo členské státy. Článek 5 odst. 3 Smlouvy o Evropské unii je nicméně úzce zaměřen na podmínky Evropské unie (jde o princip subsidiarity v užším smyslu). Domníváme se, že v evropském právu nalézá princip subsidiarity uplatnění i jako obecnější zásada – princip subsidiarity v širším smyslu. Ten má celou řadu projevů a své nejpodstatnější uplatnění nalézá v mezinárodním soudnictví, zejména u regionálních soudů pro ochranu základních práv. Tato disertační práce se zabývá aplikací principu subsidiarity v jeho užším i širším smyslu v oblasti ochrany základních práv v Evropské unii. Nejprve je analyzována historie a teoreticko filozofické základy principu subsidiarity v širším smyslu. Následně je popsán vývoj a současný stav tohoto principu v právním systému Evropské unie. Další část se pak zabývá aplikací principu subsidiarity v oblasti ochrany základních práv v Evropské unii. Nejprve je proveden krátký exkurs do systému ochrany základních práv v Evropské unii, a poté je zkoumána aplikace principu subsidiarity v sekundární normotvorbě unie na poli ochrany základních práv, v Listině základních práv Evropské unie a v rozhodovací činnosti Soudního dvora Evropské unie. Závěrečná část pojednává o roli principu subsidiarity v užším a širším smyslu jednak ve vztahu mezi Soudním dvorem a národními (ústavními) soudy, jednak ve vztahu mezi Soudním dvorem a Evropským soudem pro lidská práva.

Abstract:

The principle of subsidiarity has been a part of the legal system of the European Union since the beginning of 90s. Currently, it is to be found in article 5 paragraph 3 of the Treaty on European Union. This rule helps to determine who has the capacity to act in the area of shared competence – whether the Union or the Member States. The rule in the said article is, nevertheless, closely associated with the legal and political background of the European Union (the principle of subsidiarity in a narrow sense). I suggest that the principle of subsidiarity is used in the European law also in a more general meaning – the principle of subsidiarity in a wide sense. This meaning of subsidiarity has a number of different aspects and it is applied by international courts, particularly by regional courts of human rights. This thesis deals with application of the subsidiarity principle in its narrow and wide sense in the area of fundamental rights protection in the European Union. First, the history, the theoretical and philosophical grounds of the said principle in its wide sense are analysed. Second, the development and current status of the principle in the European Union is described. Next part is focused on the application of the principle of subsidiarity in the legal system of the European Union. A brief introduction to the system of fundamental rights protection in the European Union is followed by examination of the application of the principle in the Union’s secondary legislation, in the Charter of the Fundamental Rights of the European Union and in the decision making of the Court of Justice of the European Union. The last part discusses the role of the subsidiarity principle in its narrow and wide sense in the relationship between the Court of Justice and national (constitutional) courts and in the relationship between the Court of Justice and the European Court of Human Rights.
