Interrogation Tactics of Juvenile Victims of Crime

Abstract:

Tato diplomová práce pojednává o taktice výslechu mladistvých obětí trestných činů. Navazuje svým obsahem na práci bakalářskou Taktika výslechu – obecné problémy, kterou rozšiřuje o zvláštnosti taktiky výslechu mladistvého, o pohled na právní úpravu řízení proti mladistvým dle zákona o soudnictví ve věcech mládeže a o praktickou část – empirický výzkum formou individuálního řízeného elektronického rozhovoru s policejním vyšetřovatelem, který se v rámci svého pracovního zařazení dlouhodobě zabývá výslechy mladistvých. Úspěch výslechu, a tím i celého trestního řízení, je ovlivněn správnou volbou taktického postupu. Dokument je proto do vysoké míry zaměřen na psychologický kontakt vyslýchajícího a vyslýchaného. Na to, jak má vyslýchající působit na vyslýchanou osobu, jak má provést analýzu sdělených informací a jak vyslýchanému případně pomoci po stránce psychologické tak, aby byl trestný čin řádně objasněn a jeho pachatel usvědčen.

Abstract:

This master thesis deals with techniques of interrogation of juvenile victims of criminal offenses. It builds on the Bachelor’s thesis Interrogation technique — general problems, expanding it by peculiarities of juvenile interrogation techniques, the legal treatment of juvenile justice according to the Act on Juvenile Justice and the practical part — empirical research in the form of an individual controlled electronic interview with a police investigator, who has been conducting juvenile interviews as part of his job for a long time. The success of the interrogation, and thus of the whole of the criminal proceedings, is influenced by the right choice of approach. The paper therefore focuses on the psychological contact of the interrogator and the interrogated, that is the questions of how the interrogator should exert influence on the person questioned, how he or she should analyze the information provided and, if possible, help the interrogated person psychologically, so that the crime is properly elucidated and the perpetrator convicted.
