Tax Execution of Movable and Immovable Property from the Czech Customs' Perspective

Abstract:

Diplomová práce pojednává o daňové exekuci prodejem věcí movitých a nemovitých z pohledu Celní správy České republiky. Daňová exekuce je totiž důležitým prostředkem k vynucení platebních povinností daňových subjektů. V rámci daňové exekuce vystupují orgány Celní správy ČR v postavení správce daně. Úvodem diplomové práce se proto věnuji působnosti a kompetencím Celní správy ČR. Stěžejní část diplomové práce však tvoří kapitoly zabývající se daňovou exekucí věcí movitých a nemovitých. Cílem diplomové práce je identifikovat odlišnosti, které mohou vzniknout v porovnání s občanskoprávní exekucí. Zároveň práce popisuje legislativní rámec daňové exekuce, který je obsažený v daňovém řádu, a upozorňuje na problematické části současné právní úpravy.

Abstract:

The thesis deals with tax execution of movable and immovable property from the Czech Custom´s perspective. Tax execution is an important instrument for an enforcement of payment obligations of tax subjects. In tax execution the Czech Customs Administration acts as a tax administrator. In first part of thesis I deal with the activity and competence of Czech Customs Administration. Main part of thesis, however, consists of chapters dealing with the tax execution of movable and immovable property. The purpose of the thesis is to identify differences that may arise in comparison to civil enforcement. At the same time the thesis describes the legislative framework of a tax execution, which is contained in tax regulations and also thesis points out problematic parts of current adjustment.
