Abstract:

Ve své bakalářské práci na téma „Pohledávky osob ve výkonu trestu odnětí svobody“ se zabývám širokým spektrem oblasti pohledávek, a to nejen pohledávek, které vznikají z občansko právních vztahů a obchodně právních vztahů, ale zejména se věnuji problematice pohledávek vzniklých ve Vězeňské službě České republiky.Vězeňská služba ČR je organizační složkou státu a oblast vzniku, evidence a možnosti vymáhání pohledávek jsou velmi málo prezentovány navenek. Přes veškeré problémy, které při vymáhání vznikají, se jedná o agendu velmi specifickou a zajímavou. Samotné podmínky pro vznik pohledávky, možnost jejího umoření a zánik, jsou pro každou pohledávku individuální. Teoretická část přestavuje institut „pohledávky“ jak podle základních, obecně platných právních norem, tak podle zvláštních platných právních norem týkajících se právě Vězeňské služby ČR z pohledu výkonu vazby a výkonu trestu odnětí svobody. V práci jsou také uvedeny odlišnosti v evidenci a způsobu vymáhání justičních pohledávek ve Slovenské republice. Závěrem jsem se snažila zhodnotit všechna fakta a poznatky, které jsou v této práci uvedeny.

Abstract:

My bachelor's thesis titled „Payment obligations of people in imprisonment“ deals with wide range of matters related with payment obligations not only related to civic obligations and obligations resulting from trade commercial relations, but especially with payables which have risen during the execution of punishment in the facilities of the Prison Service of the Czech Republic.Prison Service of the Czech Republic is a state body and the problems of origin of payment obligation, the registration of obligations and the possibilities of levy are not so well known in general. Despite all related troubles, it is a very specific and interesting agenda. Each individual case has different conditions of origin, chances for exaction and settlement of outstanding debt. Theoretical part of the thesis introduces the notion of payment obligation from the point of view of general legal standards as well as from the point of view of special regulations concerning Prison Service of the Czech Republic, detention and imprisonment. The thesis touches also the differences of registration and levy in Slovak Republic. In the last part I tried to evaluate all facts and knowledge mentined in my thesis.
