Conflict executory and insolvency proceedings

Abstract:

Cílem diplomové práce je zhodnotit exekuční a insolvenční řízení z pohledu nákladů na jednotlivé činnosti. V teoreticko-metodologické části je nejprve provedena stručná historie exekučního a insolvenčního řízení. V aplikační části je stručně popsána provázanost exekučního a insolvenčního řízení a zhodnocení současné právní úpravy, dále pak zhodnocení dopadu insolvenčního řízení na prováděné exekuce. Zároveň je třeba ozřejmit vydání výtěžků mezi exekučním a insolvenčním řízení, včetně vyjasnění stanovení odměn exekutora a insolvenčního správce v průběhu času.

Abstract:

The aim of the diploma thesis is to evaluate the execution and insolvency proceedings in terms of the cost of individual activities. In the theoretical and methodological part is first performed a brief history of execution and insolvency proceedings. In the application part is briefly described the interconnection of the execution and insolvency proceedings and the statement of the evaluation with the contemporary legal regulation, as well as the evaluation and impact of the insolvency proceedings on the performed executions. At the same time, the issue of proceeds between the execution and the insolvency proceedings, including clarification of the determination of the bailiff's fees and the insolvency trustee over time.
