Legal protection of large animals in the circus

Abstract:

Bakalářská práce se věnuje problematice drezury velkých šelem v cirkusech v souvislosti s aktuální právní úpravou, zejména zákonem č. 246/1992 Sb., na ochranu zvířat proti týrání, a jeho novelou č. 501/2020 Sb., která zakázala drezuru volně žijících druhů narozených po 1. lednu 2022, jejich rozmnožování a dovoz ze zahraničí pro účely veřejného vystupování. Cílem práce je zjistit, zda jsou tyto a další zákonné podmínky dodržovány, jaký dopad má zákaz drezury na cirkusy a jak na něj reagují provozovatelé a veřejnost. Teoretická část se zabývá historickým vývojem drezury, společenským kontextem, právním rámcem a podmínkami chovu. V praktické části bylo realizováno dotazníkové šetření mezi veřejností i provozovateli cirkusů a analyzována spolupráce s kontrolními orgány. Závěry ukazují převládající podporu veřejnosti pro zákaz drezury a rozdílné postoje provozovatelů. Práce navrhuje zpřesnění právní úpravy formou stanovení minimálních podmínek chovu a vytvoření seznamu druhů, jejichž etologické potřeby lze v cirkusovém prostředí naplnit. Doporučuje rovněž zavedení povinnost informovat veřejnost o původu a podmínkách chovu zvířat.

Abstract:

This bachelor thesis focuses on the issue of training large carnivores in circuses in relation to the current legal framework, specifically Act No. 246/1992, on the protection of animals against cruelty, and its amendment No. 501/2020, which banned the training of wild animal species born after January 1, 2022, as well as their breeding and importation for public performances. The aim of the thesis is to determine whether these and other legal conditions are being honoured, what impact the ban on training has on circuses, and how circus operators and the public respond to it. The theoretical part deals with the historical development of animal training, the social context that led to the ban, the legal framework, and the conditions of animal keeping. The practical part includes a questionnaire survey among the general public and circus operators, along with an analysis of cooperation with supervisory authorities. The results show predominant public support for the ban on training and differing views among circus operators. The thesis recommends establishing minimum standards for animal keeping and the creation of a list of species whose ethological needs can be full filed in circus environments. It also suggests introducing an obligation to inform the public about their origin and the conditions in which they are kept.
