Legislation of holiday - its positives and negatives - suggesttions for amendments to Labour Code

Abstract:

Práce se zabývá současnou právní úpravou dovolené České republiky, která je součástí zákoníku práce jako jeho část devátá. Snaží se o identifikaci kladných a záporných stránek právní úpravy dovolené a použití odhalených negativ ve formě námětů na novelu zákoníku práce. K dosažení těchto cílů je použita metoda komparace mezi úmluvami Mezinárodní organizace práce č.52 o placené dovolené a č.132 o placené dovolené (revidovaná), dále analýza míry aplikace v současnosti platné úmluvy č.132 o placené dovolené (revidovaná) a směrnice Evropského parlamentu a Rady č.2003/88/ES do vnitrostátního práva České republiky. Důležité je také zhodnocení právní úpravy dovolené, jehož výsledkem je odhalení nedostatků přímo ve znění zákona. Nalezené nedostatky jsou prezentovány na příkladech a navrhnuta možná řešení. Nakonec je uveden provedený průzkum na téma placená dovolená a prezentovány jeho výsledky. To vše je doplněno o charakteristiky, které zajišťují obeznámenost se zpracovávanou problematikou.

Abstract:

The work deals with the current legislation of holiday the Czech Republic, which is part of the Labour Code as part of his ninth. It seeks to identify the strengths and weaknesses holiday legislation and the use of negatives detected in the form of suggestions for amendments of the Labour Code. To achieve these objectives, the method of comparison between the ILO Conventions No.52 Holidays with Pay Convention and No.132 Holidays with Pay Convention (Revised), further analysis of their application currently in Convention No.132 on Holidays with Pay Convention (Revised) and directive of the European parliament and of the Council No.2003/88/ES into national law of the Czech Republic. It is important to also assess regulation leave, resulting in the direct detection of deficiencies in the wording of the Act. Deficiencies found are presented with examples and suggested possible solutions. Finally, conducted a survey is given on paid leave and presented its results. All this is complemented by features that ensure familiarity with the issues elaborated.
