Office of the Government Representation in Property Affairs (its Status and Activities)

Abstract:

Tématem bakalářské práce je významná státní instituce, kterou je Úřad pro zastupování státu ve věcech majetkových. Úřad byl založen 1. 7. 2002. Základním cílem bakalářské práce je představit Úřad pro zastupování státu ve věcech majetkových (ÚZSVM) jako instituci, která garantuje veřejný zájem zejména tím, že usiluje o kvalitní právní ochranu majetku státu a řádné hospodaření s tímto majetkem. Hlavními činnostmi Úřadu pro zastupování státu ve věcech majetkových je právní zastupování, právní poradenství a hospodaření s majetkem státu. Úřad pro zastupování státu ve věcech majetkových, původně koncipovaný jako finanční prokuratura, je zástupcem státu, který ochraňuje státní majetek. Úřad by měl být tedy jakýmsi advokátem státu. Bakalářská práce je rozčleněna do třech základních částí: 1. Teoreticko-historické vymezení Úřadu pro zastupování státu ve věcech majetkových; 2. Úřad pro zastupování státu ve věcech majetkových v platné právní úpravě; 3. Činnost Úřadu pro zastupování státu ve věcech majetkových v praxi. V úvodním teoreticko-historickém vymezení je věnována pozornost funkci a postavení úřadu v systému veřejné správy, úřad je představen jako orgán veřejného zájmu. V této části je Úřad pro zastupování státu ve věcech majetkových uveden do historických a mezinárodních souvislostí. Druhá část bakalářské práce pohlíží na Úřad pro zastupování státu ve věcech majetkových z hlediska platné právní úpravy. V této části bakalářské práce je věnována pozornost zejména procesnímu jednání úřadu před soudními a jinými orgány, zastupování obcí a poskytování právních stanovisek. Druhá část práce se podrobněji věnuje také hospodaření úřadu s majetkem státu. Třetí závěrečná část bakalářské práce se věnuje vlastní činnosti úřadu v období 2004 – 2010. Z analýzy vybraných statistických ukazatelů z činnosti Úřadu pro zastupování státu ve věcech majetkových v období 2004 – 2010 vyplývá, že Úřad pro zastupování státu ve věcech majetkových se v praxi věnuje spíše nakládání a hospodaření s majetkem státu, než samotnému právnímu zastupování státu před soudy a dalšími orgány a právnímu poradenství. Z tohoto pohledu se Úřad pro zastupování státu ve věcech majetkových stává spíše agenturou pro nakládání a hospodaření s majetkem státu, než původně zamýšlenou finanční prokuraturou (advokátem státu). V závěru práce je věnována pozornost možnému řešení současného stavu z hlediska právní úpravy ve smyslu de lege ferenda.

Abstract:

The thesis “Office of the Government Representation in Property Affairs: its Status and Activities“ deals about important national institution – The Office of the Government Representation in Property Affairs, which was established on 1st of July 2002. The goal of this thesis is to present the Office of the Government Representation in Property Affairs like institution, which guarantee public interest especially thereby, that the make an effort about high quality legal protection property of the state and correct administration this property. Main activities the Office of the Government Representation in Property Affairs are legal representation, law consultancy and management of property of the state. Office of the Government Representation in Property Affairs, originally intended as a financial prosecution, is representative of the state, which preserves state property. The Office of the Government Representation in Property Affairs should be in this regard some lawyer of the state. The thesis is divided into three fundamental sections: 1. Theoretical and historical definition the Office of the Government Representation in Property Affairs; 2. The Office of the Government Representation in Property Affairs in actual legal regulations; 3. Activity of The Office of the Government Representation in Property Affairs in practice. In introductory theoretical and historical section is devoted attention function and position The Office of the Government Representation in Property Affairs in system public service, the office is described like authority of public interest. In this section is the Office of the Government Representation in Property Affairs described in historical and international context. Second part this thesis regards the Office of the Government Representation in Property Affairs in terms of actual legal regulations. In this part of the thesis is devoted attention especially procedural act Office of the Government Representation in Property Affairs before the courts and by other authorities, providing legal advices and representation municipalities. Second part the thesis in more detail describes management Office of the Government Representation in Property Affairs with property of the state. The third final part of the thesis is devoted attention activities of the Office of the Government Representation in Property Affairs in practice in period 2004 – 2010. On the basis analysis of selected statistical indicators from activities the Office of the Government Representation in Property Affairs in period 2004 – 2010 we get to the conclusion, that the Office of the Government Representation in Property Affairs in practice devotes attention rather administration of the property, than itself legal representation of the state before the courts and other authorities and providing legal consultancy. In this regard the Office of the Government Representation in Property Affairs becomes rather agency for disposal and management of property of the state, than originally intended financial prosecution (lawyer of the state). At the close of the thesis is devoted attention possible solving contemporary state in term of legal regulations in sense de lege ferenda.
