Residence of the Child after Parental Separation

Abstract:

Diplomová práce se zabývá tématem bydliště dítěte po rozchodu či rozvodu rodičů, přičemž jejím cílem je analyzovat právní úpravu určení a změny bydliště dítěte v daném kontextu podle českého právního řádu. Prostřednictvím analýzy této úpravy a zejména judikatury práce odpovídá na otázku, zda rozhodnutí českých soudů ve věci určení nebo změny dítěte po rozchodu rodičů odpovídají nejlepšímu zájmu dítěte. Text analyzuje předmětné téma v kontextu relevantní (mezinárodní, unijní i české) právní úpravy, rozebírá úpravu rozvodu rodičů ve světle novely občanského zákoníku, platné od 1. ledna 2026, a podrobně zkoumá koncept obvyklého bydliště dítěte, který je důležitý i v kontextu tzv. únosů (mezinárodních i vnitrostátních) dítěte. Práce neopomíná ani koncept nejlepšího zájmu dítěte, který by měl ideálně prostupovat veškerým rozhodováním o záležitostech dítěte.

Abstract:

The diploma thesis deals with the issue of a child’s residence after the separation or divorce of parents. Its aim is to analyse the legal regulation governing the determination and change of a child’s residence in this context under Czech law. By examining this legislation and, in particular, relevant case law, the thesis answers the question of whether decisions of Czech courts concerning the determination or change of a child’s residence after parental separation correspond to the child’s best interests. The text analyses the subject matter within the framework of relevant international, EU, and Czech legislation, discusses the regulation of parental divorce in light of the amendment to the Civil Code effective from 1 January 2026, and examines in detail the concept of a child’s habitual residence, which is also significant in the context of so-called child abductions (both international and domestic). The thesis also considers the concept of the child’s best interests, which should ideally permeate all decision-making concerning the child.
