Role of the Probation and Mediation Service and Social Legal Child Protection at work with youth after committing a crime

Abstract:

Práce pojednává o úloze probační a mediační služby a oddělení sociálně právní ochrany ve vztahu k mladistvému, který spáchal provinění. V teoretické části přibližuji vznik a historii obou organizací, dále služby, které poskytují a pravomoci, kterými ze zákona disponují. Velmi okrajově se dotýkám platné legislativy vztahující se k oběma institucím. V dalších kapitolách rozebírám dilemata sociální práce a etická hlediska používání sociální kontroly (za použití moci) a sociální práce jako pomoci. V praktické části je zkoumána spisová dokumentace vybraného vzorku mladistvých, kteří jsou ve stejné době klienty obou institucí. Výzkum je proveden za použití kvalitativní analýzy dokumentů. Výsledkem zkoumání je zjištění, že probační a mediační služba a kurátoři pro mládež mají podobné pravomoci, klientelu i cíle, ale velmi se liší tím, jak pracují. Jedná se především o poměr pomoci a kontroly.

Abstract:

The thesis dissertates about assignment of Probation and Mediation Service and Social Legal Child Protection in relation to youth, who committed a crime. The theoretical part is focused on the rise and history of both organizations, their provided services and competences, which are managed by the law. Marginally I focused on the valid legislation, which relies to both organizations. In other chapters I discuss the dilemma of social work and ethic viewpoints used for social control (by using potency and social work as support. The practical part explores the company records of a chosen youth sample, which are clients of both institutions. The research is accomplished by qualitative analysis of the documents. The result of the research is the finding, that the Probation and Mediation Service with social worker for youth have similar competences, clientele and aims, on the other hand, they differ in the way they work. It concerns the proportion of support and control.
