Defence Lawyer in the Criminal Proceedings

Abstract:

Tato práce je rozdělena na čtyři kapitoly, v nichž je popsáno postavení obhájce v trestním řízení, jeho povinnosti, oprávnění a postavení v jednotlivých fázích trestního řízení. Jednotlivé kapitoly jsou řazeny systematicky. Kapitoly jsou postupně od obecně ústavně zakotveného práva v dalších kapitolách konkretizovány a rozvíjeny. První kapitola je věnována zárukám práva na obhajobu a jejich ústavnímu a právnímu zakotvení a základním dvěma druhům obhajoby. Následně je popsáno historické postavení obhájce v trestním řízení, kdy počátek tohoto vývoje se objevuje již ve starém Římě a trvá stále až do současnosti. Dále se práce zabývá samotným obhájcem v trestním řízení, kdy se zabývá zejména jeho oprávněními a povinnostmi a jsou zde uvedeny situace, kdy je obviněný povinen být zastoupen obhájcem. Poslední z kapitol se zabývá funkcí obhájce v jednotlivých fázích trestního řízení od přípravného řízení až po hlavní líčení. Informace pro vypracování této práce jsou čerpány především z odborné literatury, aktuálních právních předpisů, časopiseckých článků, internetových zdrojů a různých rozhodnutí. Charakter této bakalářské práce je zejména popisný.

Abstract:

This work is divided into four chapters, which describe the position of the counsel for the defense in criminal proceeding, its duties, privileges and status in various stages of criminal proceeding. Individual chapters are arranged systematically. Chapters are gradually concretized and developed and they are based on general constitutional right. The first chapter is devoted to guarantees for the right to a fair hearing and their constitutional and legal ground and to the two basic types of defense. Subsequently there is described the historical position of defense counsel in criminal proceeding where the beginning of this development appears in ancient Rome and still lasts until today. The work is focused on the defense in criminal proceedings, which deals mainly with the privileges and responsibilities and given situation, where the accused is required to be represented by counsel. The last chapter deals with the functions of an advocate in various stages of criminal proceedings, from pre-trial to trial. Information for the preparation of this work are taken from the literature, current legislation, journal articles, Internet resources and different adjudication. The character of this work is mainly descriptive.
