Lawful Use of Arms and Its Relation to Legitimate Defence
Abstract:
Tato diplomová práce se zabývá rozborem oprávněného použití zbraně podle § 32 trestního zákoníku a jeho pozice mezi ostatními okolnostmi vylučujícími protiprávnost. Popisuje příslušná ustanovení zvláštních zákonů, které obsahují oprávnění použít zbraň. Dále pojednává o poněkud komplikovaném vztahu oprávněného použití zbraně a nutné obrany.
Abstract:
This thesis deals with the analysis of lawful use of arms according to § 32 of the Criminal Code and its position among the other circumstances which exclude illegality. It describes the relevant provisions of the particular statutes which contain an authorization to use a weapon. Furthermore, it treats of the somewhat complicated relation of lawful use of arms to legitimate defence.
