"Material Outbreak" of the Constitution

Abstract:

Předkládaná diplomová práce nazvaná “Materiální ohnisko ústavy” se zabývá především základními hodnotami a principy, které jsou definičním znakem moderních demokratických právních států, jež označujeme jako státy ústavní. Mezi tyto principy řadíme mj. princip suverenity lidu, přirozených- nedotknutelných práv, nebo princip dělby moci. Na těchto principech ústavní státy stojí a s nimi také padají. Dále se tato práce zabývá kompetencí Ústavního soudu rušit ústavní zákony, které jsou v rozporu s materiálním jádrem ústavy a problematikou práva lidu na odpor.

Abstract:

This theses titled “Material outbreaks of the constitution” focuses on the principles, that are fundamental for modern democratic states, such as sovereignty of the people, irrepaelable values and principles, division of the political power. These principles are essential for states based on constitution. The state is considered to be democratic and based on the rule of law only it these principles are maintained. The theses deals also with the question whether or whether not is the Constitutional court entitled to rescind “constitutional law” (in form of constitutional amendment) in case of defending the material outbreak as well as with the right of revolution which the people are entitled to.
