The case of genocide in Burma before the International Court of Justice

Abstract:

Bakalářská práce se zabývá případem genocidy Rohingů, muslimské etnické skupiny, na území Myanmaru před Mezinárodním soudním dvorem. Toto soudní řízení je zde podrobně analyzováno. V první části práce je udán kontext dění v Myanmaru společně s kontextem historie diskriminace a útlaku vůči Rohingům až do období let 2016 a 2017, kdy proti nim proběhla masivní vojenská operace. Práce se poté zaměřuje na strukturu a jurisdikci Mezinárodního soudního dvora a rozebírá jeho funkce. Následně je z blízka analyzován průběh řízení před Mezinárodním soudním dvorem mezi Myanmarem a Gambií, která tento případ otevřela. Řízení se momentálně přesouvá do fáze dokazování. Dále je řešena problematika zločinu genocidy v mezinárodním právu. Genocida má dva prvky, fyzický, tedy samotné zločiny, a duševní, tedy úmysl spáchat genocidu. Právě úmysl spáchat genocidu se jeví jako největší problém při dokazování spáchání zločinu genocidy. Práce následně komparuje toto řízení s řízením před Mezinárodním trestním soudem a Federálním soudem v Argentině pod záštitou univerzální jurisdikce. Mezinárodní soudní dvůr řeší spory mezi státy, zatímco dva ostatní soudí jednotlivce. Tyto soudy mají možnost potrestat jednotlivce zodpovědné za zločiny proti Rohingům a doplnit tak jurisdikci Mezinárodního soudního dvora.

Abstract:

Bachelor thesis deals with the case of genocide of Rohingya, a Muslim ethnic group, in the state of Myanmar before the International Court of Justice. This court trial is analyzed in a detailed way here. In the first part of the thesis, context is given on events in Myanmar as well as a historic context on discrimination and oppression towards Rohingya until the years 2016 and 2017, when a massive military crackdown occurred. Afterwards, the thesis focuses on the structure and jurisdiction of the International Court of Justice and discusses its functions. Next, the trial between Myanmar and Gambia, who opened the case before the International Court of Justice, is analyzed in a detailed manner. The court trial is currently moving towards its merits phase. Following that, the challenges of crime of genocide in international law are discussed. Genocide has two elements, a physical one, i.e. the crimes themselves, and a mental one, which is the genocidal intent. The intent to commit genocide seems to be the biggest issue while proving the crime of genocide. The thesis then compares this trial with trials before the International Criminal Court and Argentina's Federal Crime Court under the universal jurisdiction. The International Court of Justice deals with disputes between the states, the other two hold trials towards individuals. These courts have the capability to punish the individual responsible for the crimes against Rohingya and fill in the gap of jurisdiction of the International Court of Justice.
