Problematic with interrogation in within the selected local department region in Prague

Abstract:

Diplomová práce se zabývá problematikou výslechu, který je veden základním útvarem Policie České republiky. Teoretická část diplomové práce je v první části zaměřena na výslech jako kriminalistickou metodu. Popisuje jeho podstatu, cíle, jednotlivé druhy výslechu a jeho dokumentaci. V hlavní teoretické části diplomové práce jsou popsány stádia výslechu, jeho příprava a taktika. Diplomová práce také popisuje psychologii výslechu, jeho právní úpravy a také způsoby kladení otázek. Praktická část diplomové práce prostřednictvím kvalitativního výzkumu mapuje klady a nedostatky týkající se provádění výslechu ze strany policistů z vybraného útvaru. U zjištěných nedostatků se snaží navrhnout jejich odstranění nebo zlepšení. Hlavním cílem práce je zhodnotit kvalitu a úroveň provádění výslechu ze strany policistů z vybraného útvaru a zjistit, zda dodržují, co doporučuje kriminalistická teorie. Vedlejším cílem je informovat méně zkušené policisty i laickou veřejnost o problematice výslechu a poukázat na nároky kladené na vyslýchajícího policistu.

Abstract:

This thesis deals with the question of interrogation, which is led by the basic department of the Police of the Czech Republic. The theoretical part of the thesis is focused on interrogation as a forensic method. It describes its essence, aims, individual types of questioning and its documentation. The main theoretical part of the thesis describes the stages of interrogation, its preparation and tactics. The thesis also describes the psychology of questioning, its legal regulations and the ways of asking questions. Through qualitative research, the practical part of the thesis maps the pros and cons of police interrogations from the selected department. In addition, it seeks to propose solutions, or improvements, to identified deficiencies. The main aim of the thesis is to evaluate the quality and level of interrogation by police Officers from the selected department and to find out whether they adhere to principles of forensic theory. The secondary objektive is to inform less experienced police officers and the general public about questioning during interrogation and to point out the demands placed on the interrogating police officer.
