Socio-legal protection of children from the point of view/position of a curator for children and youth

Abstract:

Diplomová práce se nazývá Sociálně-právní ochrana dětí z pohledu/pozice kurátora pro děti a mládež. Jejím cílem je zmapovat vztahy mezi kurátorem pro děti a mládež, rodiči a dětmi, které se dopustily protiprávního jednání a procházejí evidencí zmíněného kurátora. V teoretické části je vymezen základní legislativní rámec kurátora pro děti a mládež a trestní odpovědnost dětí. V dalších kapitolách je obsah práce soustředěn na vymezení základní pojmů týkající se protiprávního jednání dětí, osoby kurátora pro děti a mládež a jeho nástroje, které sloužící k výkonu sociálně-právní ochrany dětí. Poslední kapitola vymezuje opatření, která se ukládají v rámci prokázání viny u dětí a mladistvých. Pět základních vztahů, které jsou popsány v praktické části, vyplynuly ze zvoleného kvalitativního výzkumu a jsou důležité pro vzájemné spolupracující vztahy. Ty ovlivňují výkon sociálně-právní ochrany dětí kurátorem pro děti a mládež. Jedná se konkrétně o vztahy, které se týkají důvěry v odbornost, nejpoužívanější nástroje a jejích účinnost, preference věkové skupiny, dobrovolní diagnostika bez soudu a možnosti součinnosti.

Abstract:

The diploma thesis is called Social and legal protection of children from the point of view/position of a curator for children and youth. Its goal is to map the relationships between the curator for youth, parents and children who have committed illegal acts and are going through the records of the said curator. In the theoretical part, the basic legislative framework of the curator for children and youth, criminal liability of children is defined. In the next chapters, the content of the work is focused on the definition of basic concepts related to the illegal behavior of children, the person of the curator for children and youth and his tools used to exercise the social and legal protection of children, and in the last chapter, the measures that are imposed in the framework of proving the guilt of children are defined and juveniles. The practical part describes 5 basic relationships that emerged from the chosen qualitative research and that are important for mutual cooperative relationships that influence the performance of the socio-legal protection of children by the curator for children and youth. Specifically, these are relationships related to trust in expertise, the most used tools and their effectiveness, age group preferences, the possibility of voluntary residence without court determination and the possibility of cooperation.
