Public Prosecutor as the Authority in Charge of Public Administration Control

Abstract:

The Bachelor thesis aims at analysing the characteristics of public administration and pointing out the possible ways of control by prosecutors applying their legal action arising from their legal legislation. The first chapter focuses on the general structure of public administration, its division after the reform dividing it into the central administration, local administration, local authorities and public corporations. It refers to the legal norms which the public administration relies on, i.e. the territorial and administrative division of the Slovak Republic. In its first part, the second chapter analyses the legislative amendment of the Institute of prosecutor and briefly explains the functions of a prosecutor in the state. The next section highlights the prosecutor's supervision over the observance of the law by state authorities. The third chapter provides methods of administration and handling of citizens' complaints, proceedings on the prosecutor’s protest listed in the administrative procedure and finally it evaluates and summarizes the results of the prosecutor's supervision performance in the area of supervision of the observance of the law in public administration and the legality of procedures and decision-making bodies of local self-government.

Abstract:

Bakalárska práca sa zaoberá a jej cieľom je analyzovať charakteristické črty verejnej správy a poukázať na spôsoby možnej kontroly prokurátorom pri aplikovaní jeho právnych prostriedkov vyplývajúcich mu z právnej legislatívy. Prvá kapitola je zameraná na všeobecnú štruktúru verejnej správy, jej rozdelenie po reforme na ústrednú štátnu správu, miestnu štátnu správu, územnú samosprávu a verejnoprávne korporácie. Poukazuje na právne normy, o ktoré sa opiera štátna správa, teda o územnom a správnom usporiadaní Slovenskej republiky. Druhá kapitola vo svojej prvej časti analyzuje legislatívnu úpravu inštitútu prokurátora a krátko vysvetľuje funkciu prokurátora v štáte. V ďalšej časti poukazuje na dozor prokurátora nad zachovávaním zákonnosti orgánmi štátnej správy. Tretia kapitola prináša spôsoby podávania a vybavovania podnetov občanov, konanie o proteste prokurátora uvedené v správnom poriadku a na záver zhodnotí a zhrnie výsledky činnosti prokurátorského dozoru v oblasti dozoru nad dodržiavaním zákonnosti vo verejnej správe a zákonnosť postupov a rozhodovania orgánov územnej samosprávy.
