Legal Status of Minor Child in Case of Parent's Divorce

Abstract:

Diplomová práce se zabývá právním postavením nezletilého v průběhu rozvodového řízení rodičů, a to z hmotně právní i procesně právní stránky. Snaží se nalézt odpověď na otázku možností nezletilého jako nositele práv, jichž se může aktivně domáhat. Zde klade důraz na vymezení rozumové vyspělosti dítěte a jeho nejlepších zájmů. Následně se věnuje orgánům, jež mají objektivně posuzovat situaci dítěte, jako jsou například znalci a orgán sociálně-právní ochrany dětí. Práce dále popisuje druhy péče o dítě a možné negativní situace, které mohou díky soudnímu rozhodnutí nastat. Proto se více zaměřuje na ovlivňování dítěte jedním z rodičů, syndrom zavrženého rodiče a další. Diplomová práce se taktéž zaměřuje na celou problematiku z mezinárodního hlediska a částečně poskytuje možnost seznámit se i s úpravou ve Spolkové republice Německo. Na základě syntézy těchto poznatků směřuje i k úpravě de lege ferenda.

Abstract:

This thesis deals with the substantive and procedural aspect of the legal status of minor child in case of parent's divorce from. It‘s aim is to answer the question whether a minor may hold rights and actively enforce them. Emphasis is put on defining mental maturity and child’s best interests. The thesis also deals with the authorities who objectively assess the situation of a child, such as experts and officials dealing with the social and legal protection of a child. This thesis then describes the types of childcare and possible adverse situations that may arise from court decisions. Therefore, the focus is on parents influencing their child, parental alienation syndrome and others. Finally, the thesis also concentrates on the entire issue from the international perspective and provides an opportunity to look at the legislation in the Federal Republic of Germany. Based on a synthesis of this knowledge it also aims to address the de lege ferenda legislation.
