Registration of local fees as claims in insolvency proceedings

Abstract:

Bakalářská práce se zaměřuje na problematiku oddlužení fyzických osob upravenou zákonem č. 182/2006 Sb., o úpadku a způsobech jeho řešení (insolvenční zákon) na úrovni obcí z pohledu správce daně. Nejčastěji se jedná o pohledávky na místním poplatku za provoz systému shromažďování, sběru, přepravy, třídění využívání a odstraňování komunálních odpadů. Uplatňování těchto pohledávek v insolvenčním řízení je v současné době často diskutované téma a jedna z možností správce daně, jak alespoň částečně uspokojit své pohledávky za dlužníkem. Dále je obsahem práce rozhodovací praxe, jak ze strany insolvenčních soudů, tak ze strany insolvenčních správců. Práce analyzuje právní předpisy a zjišťuje, zda umožňují kvalitní a efektivní činnost správce místních poplatků. Cílem bakalářské práce je analyzovat získané poznatky postupu přihlašování místních poplatků do insolvenčního řízení u vybraných obcí a na konkrétních případech.

Abstract:

The bachelor's thesis focuses on the issue of the debt relief for natural persons regulated by law number 182/2006 Coll., on bankruptcy and ways of resolving it (insolvency law) on the level of municipalities from the view of the tax administrator. These are most often receivables on the local fee for the operation of the system of collection, collection, transport, sorting of use and disposal of municipal waste. The application of these claims in the insolvency proceedings is often quite discussed topic in present days and one of options for a tax administrator, how to be able at least partly satisfy the claims for the debtor. Next, the content of the thesis is the decision-making practice, from the insolvency courts point of view and from the insolvency administrators point of view. The work analyzes the legislation and finds out whether they allow quality and effective activities of the administrator of local fees. The aim of the bachelor's thesis is to analyze the knowledge gained in the process of registering local fees in insolvency proceeding in selected municipalities and on specific cases.
