The Lisabon Treaty as a Contemporary Attempt of a Basic Law for Europe

Abstract:

Teoretická část diplomové práce představuje stručně zakládající smlouvy Evropského společenství – EHS, ESUO a Euratomu a následně se zaměřuje na další zakládající smlouvy a jejich novelizace, které měly velký vliv na průběh integrace v Evropě. Stručně je nastíněna jejich charakteristika, důvody jejich vzniku a změny, které provedly. Druhá část práce je zaměřená již konkrétně na problematiku Smlouvy o Ústavě pro Evropu, příčinám jejího vzniku, jaké hlavní změny provedla a hlavně, proč byla tak kritizována a nakonec zamítnuta. Poté následuje podrobné rozebrání tzv. Reformní smlouvy, její odlišnosti od Ústavní smlouvy, popsání jejího vzniku a věcí, které zavedla jako nové. Formou průzkumu veřejného mínění bylo zjišťováno, jaké povědomí mají občané České republiky a občané Irska o Lisabonské smlouvě, zda se o problematiku vůbec zajímají a jaké jsou jejich názory na druhé konání referenda o Lisabonské smlouvě v Irsku, jak právě s pohledu českého obyvatelstva tak z pohledu irského obyvatelstva, což byly jedny z cílů této práce.

Abstract:

The theoretical part introduces briefly the founding treaties of the European Union – EEC, ECSC and Euratom and then focuses on further founding treaties and their updating that had a great influence on the integration in Europe. Their characteristics, reasons and changes are also briefly mentioned. The second part of the thesis is specifically focused on the issues of the Treaty Establishing the Constitution for Europe, the causes of its creation, what main changes it created and mainly why it was so criticized and finally rejected. Then follows the analysis of the Reform Treaty, its differences from the Constitution Treaty, the origins and new things it had introduced. Through a public opinion questionaire it was identified, what awareness the inhabitants of the Czech Republic and Ireland have about the Lisbon Treaty, whether they are interested in the issues at all and what their opinion is on the second referendum in Ireland from the point of view of the Czech and Irish people, which was one of the goals of this thesis.
