Abstract:

Diplomová práce se zabývá registrací obcí k dani z přidané hodnoty. Je rozdělena do čtyř kapitol. V první části je vysvětleno postavení obcí v českém právním řádu, jsou zde vymezeny základní pojmy používané v systému DPH. Druhá kapitola definuje obec jako osobu povinnou k dani a jako veřejnoprávní subjekt, a uvádí příklady veřejnoprávních činností vykonávaných obcemi. Třetí část práce je věnována popisu položek zahrnovaných a nezahrnovaných do obratu obce, přičemž důraz je kladen na nejednotné výklady legislativy a rozpory tuzemského práva s evropským. Čtvrtá kapitola popisuje důvody, které nejčastěji vedou k registraci obce jako plátce DPH a hodnotí dopad novely zákona o DPH účinné od 1. ledna 2009 na počet obcí registrovaných k DPH.

Abstract:

This Thesis deals with the Municipalities and the VAT registration. It is divided into four chapters. The status of municipalities in the Czech legal system, and the basic terms used in the VAT system are explained in the first section. The second chapter defines the municipality as a taxable person and as body governed by public law, and provides examples of activities carried out by municipalities. The third part is devoted to a description of items included and not included in the turnover of the municipality, with an emphasis on inconsistent interpretations of domestic legislation and conflicts with European law. The fourth chapter describes the reasons that most often lead to registration of the municipalities as a VAT payer and assesses the impact of the amendment to a VAT Act effective from 1st January 2009 upon the number of municipalities registered for VAT.
