Drug pricing policy - the issue of reimbursement and its impact on the position of interest groups

Abstract:

Práce se zabývá cenovou politikou léčiv, především problematikou cenové a úhradové regulace léčivých přípravků a jejího dopadu na postavení zájmových skupin v České republice. S ohledem na obsáhlost zvoleného tématu je z kapacitních důvodů zaměřena pozornost jen na vybrané zájmové skupiny – pojištěnce, poskytovatele zdravotních služeb, konkrétně na poskytovatele poskytující péči formou ambulantní péče, a plátce; cenu a úhradu léčivých přípravků jako rozhodujícího korektivu při poskytování zdravotních služeb a jejich regulaci. S ní spojenou participaci zájmových skupin – Ministerstva zdravotnictví ČR, Státního ústavu pro kontrolu léčiv a ČLK. Samotná práce je rozdělena do šesti hlavních kapitol. V první kapitole je uveden exkurz do historie medicínského a farmaceutická práva, deklarující např. vznik zdravotní služby, přípravu léčiv, vznik lékáren, tvorbu prvních cen, respektive tax léčiv, vznik veřejného pojištění, systému nemocenského pojištění a zdravotní pojišťovny. Následující druhá kapitola poskytuje přehled základních pojmů, terminologii, s nimiž pracuji v celé práci a kterými přináším vhled do zvolené problematiky. Třetí kapitola se zabývá cenovou a úhradovou regulací léčivých přípravků v České republice. Čtvrtá kapitola je věnována především vztahu dvou zájmových skupin, poskytovatelů zdravotních služeb a plátců zdravotních služeb, s akcentem na regulaci poskytovatele zdravotních služeb s dopadem na třetí zájmovou skupinu, pacienty, respektive pojištěnce. Spolu s třetí kapitolou je považována za nosnou část této práce. A to vše s odezvou ve vybrané judikatuře z oblasti cenové a úhradové regulace léčivých přípravků v kapitole páté, zvláště pak s poukázáním na problémové pasáže uvedené v kapitole čtvrté. V šesté kapitole jsou nastíněna možná východiska a doporučení vedoucí ke zmírnění dopadu regulace úhrad léčivých přípravků na zvolené zájmové skupiny. V závěrečné části práce jsou shrnuty výsledky zkoumání a vyhodnocení shromážděných analyzovaných a zpracovaných vstupních podkladů a materiálů do výsledné podoby mých myšlenkových souvislostí, návrhů a podnětů, k nimž jsem dospěla při zpracovávání disertační práce.

Abstract:

The dissertation deals with the pricing policy of drugs, especially the pricing and reimbursement regulation of medicines and its impact on the position of interest groups in the Czech Republic. With regard to the broadness of the chosen topic, an attention has been drawn, for capacity reasons, to particular interest groups only – the insured, health service providers, particularly the outpatient care providers, and payers; the price and reimbursement of the medicines as the decisional corrective in health service provision and their regulation. Associated with it is a participation of interest groups – the Ministry of Health of the Czech Republic, the State Institute for Drug Control and the Czech Medical Chamber. The thesis is divided into six main chapters. The first chapter presents an excursion into the history of medical and pharmaceutical law, declaring, for example, the origination of health services, the preparation of drugs, the formation of pharmacies, determination of the first prices, or more precisely, the drug taxes, the foundation of the public insurance, of the health insurance system and of the health insurance company. The following second chapter provides an overview of basic concepts, terminology, I have been working with in the whole thesis and which bring insight into the chosen problem. The third chapter deals with the price and reimbursement regulation of medicines in the Czech Republic. The fourth chapter is devoted to the relationship between two interest groups, the health service providers and the payers of health services, with an emphasis on the regulation of the health service providers and its impact on the third interest group of patients, or more precisely, the insured. Together with the third chapter, chapter four is considered a substantial part of the dissertation. And all that has been responded to in the selected case law in the area of price and reimbursement regulation of medicines in the fifth chapter, particularly with reference to the problematic passages mentioned in chapter four. In the sixth chapter, possible solutions and recommendations have been outlined to mitigate the impact of reimbursement regulation of medicines on selected interest groups. The final part summarizes the results of exploration and evaluation of collected analyzed and processed input documents and materials to the final shape of my intellectual context, proposals and suggestions, which I have reached when processing the dissertation.
