Problematic Issues with the Implemantation of Consumption Taxes in the Food Industry

Abstract:

Tato diplomová práce se zabývá problematikou aplikace spotřebních daní v jednotlivých potravinářských oborech. Jedná se o velice rozsáhlou a složitou problematiku, kde jsem se soustředila především na oblast spotřební daně z piva. Diplomová práce podává stručný průřez přes historii spotřebních daní, jejich současnou právní úpravu v České republice a Evropské unii, jednotlivé druhy spotřebních daní v potravinářských oborech, problematiku daňových skladů, zajištění spotřební daně, okrajově se zabývá správou daní, řeší připravované změny spotřebních daní a navazuje na obdobnou problematiku v Evropské unii. V textu uvádím příklady, kdy u daně z piva využívám praktických zkušeností z oboru, ve kterém působím. V problematice spotřebních daní se v praxi často chybuje neúmyslně a lze se setkat také s celou řadou pokusů o daňové úniky, nevyjímaje potravinářské obory. Smyslem mojí diplomové práce je snaha o možnost rychlé a základní orientace v oblasti spotřebních daní v potravinářských oborech. Vzhledem k rychle se prohlubující spolupráci členských států v rámci Evropské unie chci přiblížit postupnou legislativní harmonizaci spotřebních daní.

Abstract:

This thesis deals with problems associated with the application of value added tax (VAT) and excise duties to selected sectors within the food and drink industry. This is a very extensive and complex topic, and the work focuses specifically on the beer industry, dealing with the history of VAT tax, its development in a social and historical context, and its current legal standing in the Czech Republic and the European Union. Specific issues associated with administration of taxes, changes that are required, and the expected harmonization are discussed and build on similar current issues in the EU. I have used several examples of beer taxes and associated issues that have been encountered, based on my daily experience in the beer industry. In practice, unintentional mistakes in tax administration are often made and these are usually based on a lack of understanding of the existing legislative framework. One may also meet with a number of attempts at tax evasion. This thesis aims to provide a quick and reliable guide through the complex issues of taxation in the food and drink industry and, given the increasing cooperation amongst Member States within the EU, to explain its legislative harmonization.
