Social Security in the Czech Republic and Ireland

Abstract:

Bakalářská práce se zabývá porovnáním sociálního zabezpečení v České republice a Irsku. Nejprve je charakterizováno sociální zabezpečení a jeho jednotlivé části, jsou definovány jednotlivé pojmy. Následuje uvedení pramenů práva sociálního zabezpečení v České republice a Irsku. Jsou zde uvedeny evropské prameny práva sociálního zabezpečení a jednotlivé mezinárodní smlouvy v oblasti sociálního zabezpečení. Dále následuje popis systému sociálního zabezpečení České republiky. Jsou zde popsány pojistné a nepojistné systémy sociálního zabezpečení, podpora v nezaměstnanosti. Další část této bakalářské práce se zabývá popisem systému sociálního zabezpečení Irska, jednotlivé dávky a příspěvky jsou členěny podle jednotlivých sociálních události. Následuje komparace sociálního zabezpečení v obou státech. Podrobně jsou porovnány dva státy z pohledu sociálního zabezpečení. Cílem bakalářské práce je zhodnocení vybraných systémů sociálního zabezpečení obou států. Dílčím cílem je posouzení sociálního zabezpečení v Irsku jako inspirace pro případné dílčí změny sociálního zabezpečení v České republice de lege ferenda. Při zpracovávání bakalářské práce bylo stanoveno 2 hypotézy. Hlavní hypotéza tvrdí, že dávky pro osoby samostatně výdělečné činné v Irsku budou v porovnání s Českou republikou omezovány. Daná hypotéza byla odvozena na základě členění Irska do anglosaského modelu sociálního zabezpečení. Hypotéza vedlejší předpokládá, že v Irsku existuje větší množství dávek a příspěvků pro farmáře. Hypotéza byla odvozena na základě důkladného studia historického vývoje Irska. Je používána metoda analytického studia platných právních předpisů, odborných článků, různých knižních zdrojů, které se zabývají především sociálním zabezpečením z pohledu Evropské unie nebo mezinárodního hlediska, a internetových zdrojů. Dále jsou používány metody komparace a syntézy. Závěr práce celou problematiku shrnuje a hodnotí systémy sociálního zabezpečení obou států. V závěru je také konstatováno, že po zhodnocení systému sociálního zabezpečení v Irsku nelze hypotézu hlavní považovat za potvrzenou, hypotézu vedlejší naopak považovat za potvrzenou lze.

Abstract:

The bachelor thesis deals with the comparison of social security in the Czech Republic and Ireland. Firstly, social security and its individual parts are characterized, and individual terms are defined. The following is a listing of social security law in the Czech Republic and Ireland. It lists European sources of social security law and individual international agreements in the field of social security. A description of the social security system of the Czech Republic follows. It describes insurance and non-insurance social security systems, and unemployment benefits. The next part of this bachelor thesis deals with the description of the social security system of Ireland, individual benefits and contributions are divided according to individual social events in which a person may find himself. The following is a comparison of social security in both countries. Two countries are compared in detail from the point of view of social security. The aim of the bachelor thesis is to evaluate selected social security systems of both countries. The partial goal is to assess social security in Ireland as an inspiration for possible partial changes in social security in the Czech Republic de lege ferenda. During the elaboration of the bachelor thesis, two hypotheses were set. The main hypothesis is that benefits for the self-employed in Ireland will be limited compared to the Czech Republic. The given hypothesis was derived based on the fact that Ireland belongs to the Anglo-Saxon model of welfare state. The secondary hypothesis assumes that there are more benefits and allowances for farmers in Ireland. The hypothesis was derived from a thorough study of the historical development of Ireland. The method of analytical study of valid legal regulations, professional articles, various book sources, which deal mainly with social security from the point of view of the European Union or international point of view, and internet sources is used. Furthermore, methods of comparison and synthesis are used. The conclusion summarizes the whole issue and evaluates the social security systems of both countries. In conclusion, it is also stated that after the evaluation of the social security system in Ireland, the main hypothesis cannot be considered confirmed. As for the secondary hypothesis, it can be considered fulfilled.
