The development of the judicial apparatus and the possibilities of interdisciplinary cooperation in the field of drug problematics in the Czech Republic

Abstract:

Téma bakalářské práce se zabývá úrovní činnosti justičního aparátu v problematice řešení protiprávního jednání, ovlivněného intoxikací návykovými látkami nealkoholového typu. Především se věnuje a poukazuje na nedostatky přístupu justice v řešení skutkových podstat trestných činů, které bylo způsobeno posuzováním užití návykových látek, nebo závislostním jednáním. Vzhledem k vývoji české drogové scény po roce 1989 bude poukazovat na to, do jaké míry je justičním aparátem vyžadováno předkládání důkazního materiálu policejním orgánem. A do jaké míry justice, v rámci posuzování závažnosti protiprávního jednání, zohledňuje příčinnou souvislost vlivu návykových látek na toto jednání. Zároveň si bude všímat mezioborové spolupráce justičního aparátu v návazných činnostech dalších institucí po rozhodnutí v trestním řízení. Součástí této práce je praktická část, která na základě výzkumného šetření s využitím dotazníku bude zkoumat, jaký důraz je kladen veřejností na důležitost prokazování příčinnosti protiprávního jednání pod vlivem intoxikace nealkoholovou návykovou látkou. Závěr obsahuje komplexní shrnutí nejdůležitějších informací a dat se zhodnocením naplnění cílů a záměrů touto prací sledovaných.

Abstract:

The subject of the bachelor's thesis is the level of activity of the judicial apparatus in the problem of solving illegal acts influenced by intoxication with non-alcoholic addictive substances. First of all, it focuses on and points out the shortcomings of the approach of the judicial system in solving the facts of criminal offences caused by the assessment of the use of addictive substances or addictive behaviour. Taking into account the development of the Czech drug scene after 1989, it will point out the extent to which the judicial apparatus is required to present evidence to the police and the extent to which the judicial system takes into account the causal link between the influence of addictive substances on the offence when assessing the seriousness of the offence. It will also take into account the interdisciplinary cooperation of the judicial apparatus in the follow-up activities of other institutions after the decision in the criminal proceedings. The practical part of the thesis will examine, by means of a questionnaire survey, the emphasis placed by the community on the importance of proving the causality of the offence of intoxication by a non-alcoholic addictive substance. The conclusion provides a comprehensive summary of the main information and data with an assessment of the achievement of the objectives of this work.
