The International Criminal Court and the Agression after the Review Conference of the Rome Statute

Abstract:

V červnu 2010 se v ugandské Kampale konala první Revizní konference Římského statutu Mezinárodního trestního soudu. Jejím výsledkem byl kompromisní konsensus definující poprvé v historii zločin agrese a podmínky pro výkon jurisdikce nad ním. Má práce se zabývá převážně analýzou postoje jednotlivých států i dalších aktérů k této přelomové definici. Na základě jejich vyjádření na generální debatě revizní konference jsem vytvořila typologii možných názorů na podmínky zahájení vyšetřován zločinu agrese. Pozornost jsem věnovala zejména budoucím možnostem Soudu stíhat nově definovaný zločin. Snažila jsem se odpovědět na otázky, zda mají přijaté změny Statutu vůbec potenciál něco v mezinárodních vztazích prakticky změnit a ovlivnit zaběhnuté chování a vztahy mezi státy. Přestože význam přijatých změn nemůžeme podceňovat, je podle mě pravděpodobné, že se před Soud kvůli nejrůznějším omezením jeho jurisdikce dostane pouze minimum možných případů.

Abstract:

In June 2010, there was the first Review Conference of the Rome Statute of the International Criminal Court held in Kampala, Uganda. The outcome of this conference is the compromise consensus defining for the first time in history the crime of aggression and the conditions of the jurisdiction. My thesis deals mostly with the analysis of statements of states and other actors to the definition. According to these statements presented on the general debate of the review conference, I created a typology of possible opinions on the conditions of opening an investigation of the crime of aggression. I focused mainly on the future possibilities of the Court to pursue the newly defined crime. I tried to answer the questions whether the amendments of the Statute will have the potential to change anything in international relations and influence the behaviour of states. The importance of the amendments can not be underestimated. Nevertheless, according to my opinion the Court will probably be able to judge only minimum of potential cases.
