Abstract:

Bakalářská práce se zaměřuje na významný problém současné doby, a to zadlužení fyzických osob v České republice, příčiny jeho vzniku, průběh, řešení a také jeho dopady v oblasti právní, sociální a psychologické. V teoretické části jsou vysvětleny základní pojmy týkající se této problematiky, a to v souvislosti převážně s exekučním a insolvenčním řízením dlužníků na základě studia Insolvenčního zákona, Zákona o soudních exekutorech a exekuční činnosti. Dále využívám literaturu o spotřebitelských smlouvách, ochraně spotřebitele a správě pohledávek. V aplikační části je proveden sběr informací o vzniku zadluženosti osob, jejich třídění, analýza a jejich vyhodnocení. Zadlužení osob je možné řešit několika způsoby, jež budou také předmětem této části. Na základě všech informací a poznatků je cílem blíže určit skupinu osob, jež tyto problémy sužují, odhalit příčiny vzniku zadluženosti a navrhnout zlepšení situace současného stavu v této oblasti.

Abstract:

This thesis focuses on the major problem of current time, and that is the debt of natural persons in the Czech Republic, the causes of its origin, course, solutions, and its impact on the legal, social and psychological spheres.The theoretical part explains the basic concepts related to this issue, which means the connection mostly with the execution and insolvency proceedings borrowers based on studies of the Insolvency Act, the court executors and execution activities. Furthermore, I used literature on consumer contracts, consumer protection and the management of receivables.The application part is designed to collect information about the indebtedness of natural persons, their classification, analysis and assessment.The indebtedness may be solved in several ways, which are the subject of thes section as well.On the basis of all given information and knowledge the aim is to specify a group of people being distressed by the issues, to uncover the causes of indebtedness and propose improvements of the current state in this area.
