Contracts Negotiated away from Business Premises - Roadshows in the Czech Legal System and in the Practice

Abstract:

Diplomová práce pojednává o spotřebitelských smlouvách uzavřených mimo obchodní prostory. Část práce se zaměřuje na předváděcí akce, během kterých spotřebitel uzavírá tyto smlouvy. Cílem předkládané práce je zjistit, jak se po účinnosti zákona č. 89/2012Sb. změnila právní úprava smluv uzavřených mimo obchodní prostory a porovnat ji s předchozí úpravou. Na začátku práce je zmíněna komunitární úprava v této oblasti, poté jsou zanalyzována ustanovení zákona č. 89/2012 dopadající na smlouvy mimo obchodní prostory. Dále je komparována stávající úprava s předešlou a s úpravou v zahraničí. Na závěr jsou navrhnuta možná legislativní řešení de lege ferenda, která by zvýšila ochranu spotřebitele při uzavírání těchto smluv.

Abstract:

The focus of the diploma thesis are a consumer contracts negotiated away from a business premises. A part of the thesis focuses on a road shows, during which consumer makes these contracts. The aim is to find out about a impact and change of a legal regulation of these contracts negotiated away from a business premises after a new civil code came into a force and to compare the legal regulation with the previous legal regulation. There is a mention of a European Union legal regulation of these contracts at the beginning of the diploma thesis. After that provisions of the new civil code related to the contracts negotiated away from business premises have been analyzed. In the next part a new legal regulation has been compared with the previous legal regulation and with a legal regulation of foreign countries. In the end of the thesis is suggested a new possible legal solution to protect the customer while making these contracts.
