The Civilizational Legal Roots of the Present Time and their Analysis

Abstract:

Diplomová práce se zabývá problematikou prolínání práva a náboženství v naší kulturní oblasti. Vzhledem ke skutečnosti, že v dnešní době dochází vlivem migrace k mísení náboženských směrů, které jsou více či méně fundamentální, dochází tak ke střetu civilizací s různými právními řády, kde jsou lidská práva chápána zcela odlišně. Právě zmíněné pojetí lidských práv je hlavní diferencí rozdělující západní a východní společnost. Cílem diplomové práce je zhodnocení a vysvětlení vztahu civilizačně právních kořenů a jejich vlivu na současnost. Dalším cílem této práce je poukázat na značnou kulturní diferenciaci a zároveň poskytnout čtenáři srozumitelným a uceleným způsobem vlastní pohled na problematiku. Čtenář si tak může snáze uvědomit, co se pod zmiňovanou diferenciací rozumí.

Abstract:

Diploma thesis deals with the problematics of the penetration of the law and religion in our cultural area. Given the fact, that nowadays, due to influence of migration, is occurring to mixing of religious cultures, which are more or less fundamental, that causes a clash of the civilizations with different legal systems, where are human rights considered in different ways. Just mentioned concept of the human rights is the main difference dividing western and eastern society. The aim of the diploma thesis is to evaluate and to explain the relationship of the civilization-legal roots and their impact on the present time. Another aim of this thesis is to point out on the considerable cultural differentiation and to provide the reader with a comprehensible and comprehensive ways of looking at the issue. That makes it easier for the reader to realize, what is meant by the differentiation.
