The consumer protection in the Civil Code with a focus on information obligation

Abstract:

Bakalářská práce je zaměřena na problematiku informační povinnosti jako prostředku ochrany spotřebitele. Stěžejním cílem je zhodnotit, zda je právní úprava informační povinnosti dostatečně ukotvena v zákoně č. 89/2012 Sb., občanský zákoník, který je kodexem soukromého práva. K naplnění stanoveného cíle je použita zejména podrobná analýza právních ustanovení a metoda komparace. Primárně se práce zabývá obecnou informační povinností, informační povinností u smluv uzavíraných distančním způsobem a mimo obchodní prostory, jejíž úprava je do značné míry posuzována v souvislosti s implementací Směrnice Evropského parlamentu a Rady 2011/83/EU, ze dne 25. října 2011 o právech spotřebitelů. Rozbor zakotvení informační povinnosti je doplněn o definice základních pojmů a obecné pojetí ochrany spotřebitele. V neposlední řadě je v této práci poukázáno na mnoho nesrovnalostí, které mohou vést k interpretačním a aplikačním problémům. V některých případech reaguji na tyto nedostatky a přicházím s návrhy de lege ferenda.

Abstract:

The bachelor thesis is focused on issues of information obligation as one of the means of consumer protection. The main aim of the thesis is to assess whether legislation of information obligation is sufficiently set by the Act no. 89/2012 Coll., the Civil Code, which is the code of private law. To meet the aim, the detailed analysis of the legal provisions and the method of comparation is used. Primarily, the thesis deals with the general information obligation, information obligation under distance contracts and off-premises contracts, the regulation of which is largely considered in connection with the implementation of Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights. Basic definitions and the general concept of comsumer protection are complement to the analysis of legal regulation of information obligation. Last but not least, the bachelor thesis points out that there are many discrepancies that may lead to the interpretative and application problems. In some cases, I react to these deficiencies and come up with the proposals de lege ferenda.
