Does the USA need the International Criminal Court or does the International Criminal Court need the USA?

Abstract:

Bakalářská práce si klade za cíl odpovědět na otázku, zda a pro koho je přínosné, aby USA Statut MTS ratifikovaly či nikoli. Práce zpočátku pojednává o vlivu USA na formulování MTS, jsou zde zachyceny základní konfliktní linie promítající se celým vyjednáváním o Statutu. Následně práce stručně popisuje americkou pozici k MTS (od obstrukcí charakterizovaných bilaterálními dohodami přes snahu prosadit rezoluce na půdě Rady bezpečnosti OSN až k tichému smíru s aktuálním stavem). Autorka rozebírá potenciální výhody a nevýhody přistoupení USA ke Statutu nejen z pohledu amerického, ale i z pohledu MTS. Z práce vyplývá, že za aktuálního stavu není ani pro jednu stranu conditio sine qua non přistoupení USA k MTS. Americká ratifikace by však mohla být výhodnou jak pro USA, tak pro MTS. V současné době, kdy o přistoupení není rozvířena širší debata na vysoké vládní úrovni, je ocenitelná zejména snaha o tichou kooperaci mezi oběma stranami.

Abstract:

The aim of this bachelor thesis is to examine and analyze the potential importance and need of the United States to ratify the Statute of the ICC, as well as who it is more beneficial towards. This paper begins by examining the influence of the United States in the establishment of the ICC, and whether or not there are any conflicts that were evident between the two parties in the process of negotiating the ICC Statute. Furthermore, the paper will outline the American position towards the ICC, including the obstructions that are posed and characterized by bilateral negotiations, as well as the attempts by the United States to influence the United Nations Security Council in passing certain resolutions, and finally, examine the current status of relations, which appear to be in a quiet and peaceful trance that few are aware of. The potential benefits and drawbacks of American support of the ICC Statute and its ratification are the key factor analyzed by the author from both the perspective of the United States, as well as that of the ICC itself. The paper concludes that the current state of affairs pertaining to the ICC and the support of the United States is conditio sine qua non for both parties; however, it is worth noting, that American support of the ICC would potentially be beneficial overall. While there currently isn’t further dialogue among high standing politicians regarding official American support and partnership, it is noteworthy that the United States and the ICC are quietly cooperating on joint issues.
