Abstract:

Cílem předložené bakalářské práce je v první řadě popis Ústavního soudu České republiky, vysvětlení důležitých pojmů, přiblížení fungování této instituce a její zařazení v rámci dělby moci ve státě. V praktické části jsem pro analýzu činnosti Ústavního soudu České republiky zvolil nálezy dotýkající se svobody projevu. Svoboda projevu patří k zásadním právům každého občana demokratického státu. Bez ní a dalších zásadních základních práv by základ pro demokratickou formu vlády nemohl vzniknout. Obsahem úvodní kapitoly je vymezení struktury Ústavního soudu a definice ústavy, která Ústavní soud zastřešuje. Druhou kapitolu tvoří historie ústavního soudnictví, která se formovala po mnoho let. Základem myšlenky pro vznik ústavního soudnictví byla potřeba dohledu nad dělbou moci a vyvážení moci zákonodárné, výkonné a soudní. Bylo nutné zabránit zneužívání moci jednotlivcem a také zřídit kontrolní orgán dohlížející na ústavnost výkonu státní moci. Ve třetí kapitole se okrajově zabývám komparací difúzního a koncentrovaného modelu ústavního soudnictví a posláním ústavního soudnictví, kterým je jak dohled nad ochranou ústavnosti, tak i dotváření práva především výkladem ústavy. Věnuji pozornost i státům jako Velká Británie a Spojené státy americké, které měly na formování ústavního soudnictví významný vliv a z těchto ústavních systému se učíme dodnes. Práce je rozčleněna do dvou částí. Teoretická část je členěna na tři kapitoly a praktická na dvě kapitoly, přičemž každá kapitola obsahuje jeden nález, který je následně podroben zkoumání. To znamená, že v praktické části se zaměřuji na nálezy Ústavního soudu a jimi napadnutá rozhodnutí. Pro účely bakalářské práce jsem vybral dva nálezy týkající se kolize dvou základních práv garantovaných Listinou základních práv a svobod. Tyto nálezy analyzuji a z této analýzy vytvářím syntézu výsledků.

Abstract:

The aim of the submitted bachelor thesis is primarily a description of the institution of the Constitutional Court of the Czech Republic. Explanation of important terms, approach to its functioning or peculiarities in the classification of the division of power in the state. In the next part, in the analysis of individual findings, I chose freedom of speech as a common unifying factor. Freedom of expression is one of the fundamental rights of every citizen of a democratic state. Without it and other basic fundamental rights, the basis for a democratic form of government could not be established. The content of the introductory chapter is the definition of the structure of the Constitutional Court and the definition of the Constitution, which covers the Constitutional Court. The second chapter is the rich history of the constitutional judiciary, which has been formed over many years. The idea for the creation of a constitutional judiciary was based on the need to supervise the division of power and the balance of legislative, executive and judicial power. It was necessary to prevent the abuse of power by individuals and it was necessary to set up a control body. In the third chapter I deal to some extent with a comparison of the diffuse and concentrated model of constitutional justice and the mission of constitutional justice, which is both the supervision of the protection of constitutionality and the completion of law, mainly the interpretation of the constitution. I also pay attention to states such as the United Kingdom and the United States, which have had a huge influence on the formation of the constitutional judiciary, and we are still learning from these constitutional systems. The work will be divided into two parts. The theoretical part is divided into three chapters and the practical part into two chapters, each chapter containing one finding, which is then examined. This means that in the practical part I focus on the findings of the Constitutional Court and the decision challenged by them. For the purposes of the bachelor's thesis, I selected two findings and their common conflict with the Charter of Fundamental Rights and Freedoms. I analyze these findings and from this analysis I create a synthesis of the results.
