The authorised Using of the Weapons as the Circumstance eliminating Illegality

Abstract:

This diploma thesis examines institute of authorized use of weapon as one of the circumstances excluding illegality, adjusted in Criminal Code. Specificity of this institute is that the conditions of its effects are contained in other legal enactments. The main goal of this thesis is analysis of special legal enactments, governing the authorized use of weapon, to which the Criminal Code refers. Based on this analysis, this thesis defines authorized use of weapon among other circumstances excluding illegality and evaluates given regulation.

Abstract:

Diplomová práca skúma inštitút oprávneného použitia zbrane ako jednu z okolností vylučujúcich protiprávnosť upravenú trestným zákonníkom. Špecifikom tohto inštitútu je, že podmienky jeho účinku sú obsiahnuté v iných právnych predpisoch. Cieľom práce je analýza zvláštnych právnych predpisov upravujúcich oprávnené použitie zbrane, na ktoré trestný zákonník odkazuje. Na základe tejto analýzy práca vymedzuje oprávnené použitie zbrane medzi inými okolnosťami vyučujúcimi protiprávnosť a hodnotí danú úpravu.
