The control of delegated powers executed by regions and municipalities - the current situations and opportunities for further development

Abstract:

Bakalářská práce pojednává zejména o provádění kontroly výkonu přenesené působnosti obcí a krajů – současný stav a možnosti dalšího vývoje. Po úvodu, kde je vymezena základní problematika, je v první kapitole teoreticky pojednáno o pojmech dozor a kontrola a vymezení přenesené a samostatné působnosti. Toto vymezení je podstatné, neboť používání pojmů dozor a kontrola v praxi (dokonce i při jednáních na ústředních orgánech státní správy) působí určité problémy s nepochopením obsahu těchto pojmů. Druhá kapitola se věnuje aktuálním legislativním změnám v této oblasti. Parlamentem ČR byl přijata s účinností od 1. července 2006 novela zákonů o územních samosprávných celcích (zákony o obcích, o krajích, o hlavním městě Praze) a další zákony, díky kterým dochází k podstatným změnám zejména v oblasti dozoru a kontroly nad výkonem samostatné a přenesené působnosti územních samosprávných celků. Dochází k oddělení institutů dozoru a kontroly, nově jsou vymezeny dozorové kompetence, kdy dozor nad samostatnou působností je kompletně svěřen Ministerstvu vnitra, dozor nad přenesenou působností obcí krajským úřadům a dozor nad přenesenou působností krajských úřadů a hlavního města Prahy je svěřen věcně příslušným resortům. Kontrola výkonu přenesené působnosti krajů a hlavního města Prahy je i nadále svěřena věcně příslušným ministerstvům a jiným ústředním správním úřadům, kontrola výkonu přenesené působnosti obcí je stejně jako doposud svěřena krajským úřadům. Byl zaveden nový institut kontroly výkonu samostatné působnosti územních samosprávných celků, kterou provádí Ministerstvo vnitra. Nyní tak lze kontrolovat plnění úkolů a využívání kompetencí orgány obcí v rámci samostatné působnosti. Zobecňování poznatků a jejich poskytování orgánům územní samosprávy se může v konečném důsledku projevit zlepšením (zefektivněním) výkonu samostatné působnosti orgány obcí. Bakalářská práce postihuje vysvětlení těchto změn, řešení možných problémových situací v praxi. Ve třetí kapitole je zachycena koordinační role Ministerstva vnitra při kontrolách výkonu přenesené působnosti, kde budou popsány jak konkrétní koordinační výstupy, tak i konkrétní praktické poznatky. V poslední čtvrté kapitole je přistoupeno k nastínění zcela nové právní úpravy, která sice zcela zásadně překračuje oblast kontrol přenesené působnosti, ale její přijetí by se nepochybně bezprostředně zásadně dotklo i výkonu těchto kontrol. Jedná se o nový zákon o kontrole, který by mohl vymezovat procesní pravidla pro výkon kontrol prováděný orgány veřejné správy. Takovýto zákon by měl velmi širokou působnost a znamenal by zcela zásadní změnu v právním řádu v oblasti kontroly veřejné správy. V závěru práce jsou konstatovány souhrnné zhodnocení, a to zejména, že současná právní úprava kontrol přenesené působnosti je na velmi dobré úrovni, přesto by případný nový zákon o kontrole, který by procesně upravoval kontrolní činnost většiny orgánů veřejné správy, byl přínosem právě díky svému sjednocujícímu faktoru.

Abstract:

This bachelor thesis is focused on the control of delegated powers executed by regions and municipalities – analyses the current situation and elaborates on the further development opportunities. The first chapter brings the definitions of „supervision“ and „control“. Full understanding of the difference is crucial for avoidance of the problems with understanding and interpretation. The second chapter describes the recent changes in the legal framework. The Parliament of the Czech Republic adopted the amendment of Acts on Territorial Self-Governing Units (the Act on Municipalities, the Act on Regions and the Act on the Capital city of Prague) and other Acts effective from 1st of July 2006, which brought substantial changes mainly in the area of supervision and control over the execution of independent and delegated competence of territorial self-governing units. The institutes of supervision and control are going to be separated and the supervisory competences are newly defined. The supervision over the independent competence is completely delegated to the Ministry of Interior, the supervision over the delegated competence of Municipalities to the regional offices and the supervision of the delegated competence of regional offices and the Capital city of Prague is delegated to the competent authorities. The control over the execution of the delegated competence of regions and the Capital city of Prague remains in hands of the competent Ministries and another central administrative authorities. The control over the execution of the delegated competence of Municipalities remains delegated to the regional offices. Newly was introduced legal institute for the control of the execution of the independent competence of territorial self-governing units, which executes the Ministry of Interior,. As such, the Ministry can control the fulfillment of the tasks and the use of competences by municipal authorities within their independent competence. The generalization of know-how and its distribution to the territorial self-governing authorities can lead to the improved (more effective) execution of the independent competence of territorial self-governing authorities. This bachelor thesis solves practical problems and situations of process of legal framework control. The third chapter outlines the system of cooperation and coordination power of Ministry of Interior at the process of the control of delegated powers executed by regions and municipalities, mainly the report for Government. The last chapter is dedicated to preparation of new legal framework of control which should solve almost all control processing in public administration and interfere to wider part than control of delegated powers executed by regions and municipalities. The new law about control shoud solve the rules of process of control. The last part brings the conclusion, according to which the current legal framework is on very high level. Still, the new law of control could be useful for control of delegated powers thanks to it’s unifying approach
