The non-regulation of Internet Sports Betting in the Czech republic in the context of case law of the CJEU

Abstract:

Předkládaná práce se zabývá otázkou slučitelnosti zastaralé české právní úpravy internetového kursového sázení v České republice, s principy, vyplývajícími z judikatury Soudního dvora Evropské unie. Zákon č. 202/1990 Sb., o loteriích a jiných podobných hrách, ve znění pozdějších předpisů, totiž internetové kursové sázky explicitně neupravuje, ale přesto jsou nestandardním postupem - pomocí zmocňovacího ustanovení zákona o loteriích - Ministerstvem financí povolovány.Stávající právní úprava navíc umožňuje zahraniční majetkovou účast pouze v případě sázkových her v kasinu, zatímco u ostatních sázkových her stanoví povinnost sídla provozovatele v České republice, což se může jevit z hlediska evropského práva jako problematické. Pochybnosti vzbuzuje i návrh připravovaného zákona o provozovaných sázkových hrách, neboť ponechal povinnost sídla pro provozovatele. S ohledem na skutečnost, že nejasné jsou i systematika a ústřední pojmy zákona o loteriích, po vytyčení teze v úvodu následuje druhá kapitola, věnovaná vymezení pojmu hazardní hra a jeho pojmovým znakům. Následuje třetí kapitola, zaměřená na genezi právní úpravy hazardních her na českém území a vysvětlující původce pojmové roztříštěnosti. Čtvrtá kapitola se orientuje na deskripci současného právního stavu v ČR, seznamuje čtenáře s prameny právní úpravy hazardních her obecně, a dále jmenovitě se stávajícím zákonem o loteriích, výkonem státního dozoru a správním trestáním.O kursových sázkách a internetových kursových sázkách v českém právním prostředí podávají přehled pátá a šestá kapitola. Ačkoli je internet považován za pouhý způsob, jehož prostřednictvím může být hazardní hra nabízena, a ne jiný typ hry, v ČR tomu tak není, a proto jsou kursová a internetová kursová sázka popsány v samostatných kapitolách. Kapitoly přináší definici jednotlivých sázek, vysvětlení povolovacího režimu, a závěrem jsou rekapitulovány kritické body právní úpravy. Sedmá a osmá kapitola podrobně rozebírají regulaci on-line hazardních her v EU. Hazardní hry sice nejsou na úrovni EU dosud harmonizovány, Soudním dvorem však bylo potvrzeno, že jako služby s přeshraničním dosahem spadají pod ustanovení Smlouvy o fungování EU. Osmá kapitola je tudíž věnována analýze judikatury Soudního dvora EU a zásadám z ní vyplývajícím pro právní úpravu v České republice. Z judikatury Soudního dvora lze dovodit, že členské státy musí při uplatňování omezení internetového hazardu postupovat v souladu se zásadami nediskriminace, konzistentnosti, přiměřenosti a proporcionality. S ohledem na rozbor judikatury Soudního dvora, a s ohledem na Soudním dvorem výslovně konstatovanou diskriminaci a neslučitelnost s čl. 49 SFEU v případě, že členským státem je stanovena povinnost poskytovatele hazardních služeb mít sídlo v tuzemsku, byla v závěru práce potvrzena teze nekompatibility zákona o loteriích a zákona o provozování sázkových her s právem EU. Kritizovaný zákon o loteriích navíc nesplňuje požadavek na jasnost a srozumitelnost právní úpravy, a nezajišťuje dostatečnou ochranu mladistvých.

Abstract:

This thesis deals with the question of the compatibility of the obsolete Czech legislation on the Internet betting with the principles arising from the case law of the Court of Justice of the European Union. Although the Act No. 202/1990 Coll. on Lotteries and other similar games does not explicitly regulate the Internet betting yet it is authorized by the Ministry of Finance during a non-standard procedure due to the enabling provisions of the Law on Lotteries.The current legislation allows foreign equity participation only in the case of casino gambling whereas other forms of games of chance require a registered office in the Czech Republic which may appear in terms of European law as problematic. The Draft Act on the operation of games of chance also raises doubts since leaving office obligation for the operator. With regard to the fact that there are unclear systematics and the key terms of the Act on Lotteries, after setting out the thesis in the introduction followed a second chapter devoted to the definition of gambling and its conceptual character.The third chapter is focused on the genesis of gambling legislation in the Czech Republic and explains the originator of conceptual fragmentation. The fourth chapter concentrates on the description of the current legal situation in the Czech Republic and introduces a reader to the sources of legal regulation of gambling in general and specifically with the existing Act on Lotteries, with the State supervision and an administrative punishment. An overview of a traditional betting and the Internet betting is given in the fifth and sixth chapters. Although the Internet is regarded simply as a way whereby the gambling might be offered, and not another type of game, this is not the case of the Czech Act. Therefore, traditional betting and online betting are described in separate chapters providing a definition of bets, an explanation of the authorization system and critical issues of recapitulated legislation.The seventh and eighth chapter discuss in detail the regulation of on-line gambling in the EU. Games of chance are not yet harmonized at the level of EU but it was confirmed by the Court that they fall as cross-border services under the provisions of the Treaty on the Functioning of the EU. Thus, the eighth chapter relates to the analysis of case law of the Court of Justice of the EU and of the involved principles. From the case law can be concluded that the Member States shall apply restrictions on Internet gambling in accordance with the principles of non-discrimination, consistency, suitability and proportionality. In the light of detailed analysis of the case law and with regard to the Court which declared to be incompatible with Article 49 TFEU, if the Member state laid down a mandatory obligation for the gambling service provider to be established in the member country it was confirmed the argument of incompatibility of the Act on Lotteries and the Act on operation of games of chance with EU law. Moreover, the criticized Act on Lotteries does not meet the requirement for clarity and comprehensibility of legislation and does not ensure an adequate protection of minors.
