Diplomová práce řeší problematiku testu vlastního kapitálu, který od 1. 1. 2021 dopadá na obě formy kapitálových společností. Jejím cílem je porovnat, do jaké míry se původní záměr evropské předlohy testu vlastního kapitálu kryje se současným pojetím § 40 odst. 1 ZOK. The diploma thesis deals with the issue of the equity capital test, which since 1 January 2021 applies to both forms of capital companies. The aim is to compare the extent to which the original intention of the European draft equity capital test coincides with the current concept of Section 40(1) of the Business Corporations Act.
