Deciding of jurisdictional disputes

Abstract:

Tématem diplomové práce je rozhodování kompetenčních sporů, to je sporů mezi orgány o to, kdo z nich má pravomoc v dané věci jednat a rozhodnout. Rozhodování kompetenčních sporů je v České republice svěřeno nadřízeným správním orgánům, Nejvyššímu správnímu soudu, zvláštnímu senátu zřízenému dle zákona č. 131/2002 Sb., o rozhodování některých kompetenčních sporů a Ústavnímu soudu. Hlavním cílem diplomové práce je postihnout problematiku rozhodování kompetenčních sporů rozhodovaných zvláštním senátem zřízeným dle zákona č. 131/2002 Sb., o rozhodování některých kompetenčních sporů, která dosud ještě není příliš zmapovaná. Práce je členěna do čtyř základních kapitol, kterými jsou pravomoc civilních soudů, kompetenční spor, rozhodování kompetenčních sporů a úvahy de lege ferenda. První kapitola se zabývá obecným vymezení pojmu pravomoc a pravomocí jednotlivých stran kompetenčních sporů rozhodovaných zvláštním senátem, kterými jsou civilní soudy, správní soudy a správní orgány. Ve druhé kapitole je popsán kompetenční spor, způsob jeho vzniku a druhy kompetenčních sporů. Třetí kapitola je věnována zvláštnímu senátu a jeho judikatuře, na konci kapitoly je vytvořena statistika rozhodování zvláštního senátu. Čtvrtá kapitola pak odráží současný stav dané problematiky včetně protichůdných názorů v odborné veřejnosti. Závěr práce vychází s poznatků, ke kterým autorka dospěla při zpracování práce, z prostudované judikatury a z úvah de lege ferenda. Přiklání se k té části odborné veřejnosti, která obhajuje existenci zvláštního senátu. V jeho judikatuře a jejím respektováním spatřuje i způsob předcházení většině kompetenčních sporů.

Abstract:

The topic of the thesis is the deciding of jurisdictional disputes, that is disputes between the bodies about which of them has the jurisdiction to act and decide on the matter. In the Czech Republic, deciding of jurisdictional disputes is entrusted to superior administrative bodies, the Supreme Administrative Court, the special chamber established under Act No. 131/2002 Coll and the Constitution Court. The main aim of the thesis is express the issue of deciding of jurisdictional disputes, that are decided by a special chamber established under Act No. 131/2002 Coll.. The thesis is divided into four basic chapters, which are the jurisdiction of civil courts, jurisdiction dispute, deciding of jurisdictional disputes and considerations de lege ferenda . The first chapter is concerned with the general definition of the concept of jurisdiction and the jurisdiction of individual parties to jurisdiction disputes decided by the special chamber, which are civil courts, administrative courts and administrative bodies. The second chapter describes the jurisdictional dispute, the way of its formation and the types of jurisdicional disputes. The third chapter is devoted to the special chamber and its case-law. At the end of the chapter is create statistics of decisions of the special chamber. The fourth chapter then reflects the current situation of the issue, including conflicting views in the professional community. The conclusion of the thesis is based on knowledge gained by the author during the thesis elaboration, from the studied case-law and from the considerations de lege ferenda . She is in favor of the part of the professional community that advocates the existence of a special chamber. In case-law of the special chamber and in her respect, the author sees the way of preventing most jurisdictional disputes.
