Maintenance in the Czech Republic and its enforceability

Abstract:

Bakalářská práce se zabývá problematikou vyživovací povinnosti v České republice a možnostmi vymáhání. Teoretická část obecně zohledňuje principy stanovení této povinnosti a rozlišuje její jednotlivé druhy. Seznamuje s povinnostmi a právy, které vyplývají z jednotlivých druhů vyživovacích povinností. Rovněž se věnuje určení rodičovství, které v oblasti výživného zastupuje podstatnou úlohu. Nelze opomenout významnost práva oprávněného výživné vymáhat a případné uložení trestů za neplnění vyživovací povinnosti. V praktické části jsou pomocí kvalitativního výzkumu, na základě odpovědí vybraných respondentů, zkoumány příčiny neplnění vyživovací povinnosti osobou povinnou.

Abstract:

The bachelor thesis deals with the issue of maintenance obligations in the Czech Republic and the possibilities of enforcement. The theoretical part generally takes into account the principles of establishing this obligation and distinguishes its individual types. It introduces the obligations and rights arising from the different types of maintenance obligations. It also deals with the determination of parentage, which plays an essential role in the area of maintenance. The importance of the right of the person entitled to enforce maintenance and the possible imposition of penalties for failure to fulfil maintenance obligations cannot be overlooked. In the practical part, the reasons for the failure of the obligor to fulfil the maintenance obligation are examined by means of qualitative research, based on the answers of selected respondents.
