Frauds targeting seniors

Abstract:

Tématem diplomové práce je trestná činnost páchaná na seniorech. V úvodních kapitolách jsou vymezeny pojmy senior a seniorní věk, je pojednáno o dopadech trestných činů na oběť a o právní ochraně seniorů. Dále jsou vymezeny trestné činy, jejichž oběťmi se senioři stávají nejčastěji. Práce je zaměřena zejména na podvody, představuje nejčastější modely podvodného jednání směřujícího na osoby vyššího věku a podrobněji se věnuje podvodům páchaným pod legendami „Vnuk-notář“ a „Vnuk-dopravní nehoda“. Popsán je způsob provedení těchto trestných činů, které jsou organizovanými skupinami pachatelů páchány nejen u nás, ale i v mnoha dalších státech Evropy. Práce popisuje činnost policie v rámci přípravného řízení a představuje metody a postupy, které jsou při objasňování této trestné činnosti využívány, poukazuje na nutnost mezinárodní policejní spolupráce. Pojednáno je o opatřeních, která pachatelům jejich činnost znesnadňují a o významu prevence.

Abstract:

The topic of this thesis is crime against the elderly. In the introductory chapters, the terms senior and elderly are defined, the effects of crime on the victim and the legal protection of the elderly are discussed. Furthermore, the crimes of which seniors are the most frequent victims are defined. The thesis focuses in particular on fraud, presents the most frequent models of fraudulent behaviour directed at the elderly and examines in more detail the frauds committed under the legends of "Grandson-notary" and "Grandson-traffic accident". It describes how these crimes are carried out by organised groups of perpetrators not only in this country but also in many other European countries. The work describes the activities of the police in the framework of the preliminary proceedings and presents the methods and procedures used in the clarification of these crimes, pointing out the necessity of international police cooperation. It discusses the measures that make it difficult for perpetrators to carry out their activities and the importance of prevention.
