Case-law of the Court of Justice relating to Value Added Tax

Abstract:

Diplomová práce je zaměřena na judikaturu ESD v oblasti DPH a její praktickou aplikaci v ČR. Objasňuje základní ekonomickou a právní charakteristiku pojmu daň, vysvětluje ve stručnosti dělbu pravomocí Společenství a členských států v daňové oblasti, včetně prováděcích nástrojů Společenství v rámci sbližování právních předpisů členských států, popisuje systém komunitárního práva a jeho legislativní proces. V diplomové práci je též ve stručnosti popsán harmonizační proces DPH a spotřebních daní. Diplomová práce se zabývá základní charakteristikou transpozice a implementace aktů komunitárního práva do právního řádu ČR. Na některých případech dokumentuje postupný převod konzistentní judikatury ESD do právního řádu ČR v rámci činností orgánů moci zákonodárné, výkonné a soudní.

Abstract:

This Diploma Thesis is focused on the case-law of the ECJ in the area of VAT and its application in the Czech Republic. It clarifies basic economic and law characteristic of the term tax, explains briefly the division of powers of the Community and member states in the tax area, includes implementing instruments of the Community in terms of approximation of the laws of the member states, describes system of the Community law and its legislation process. In this Diploma Thesis is likewise concisely described the process of VAT and excise duty harmonization. The Diploma Thesis concerns itself with basic characteristic of the transposition and implementation of the Community law acts into the Czech law system. On certain examples proves by evidence the gradual conversion of consistent case-law of the ECJ into the Czech law system within the activities of legislative, executive and judicial authorities.
