The second Copyright Package of the European Commission and its Legal Aspects

Abstract:

Tato diplomová práce se zabývá právními aspekty Evroskou komisí předloženého reformního autorskoprávního balíčku ze dne 14. září 2016, zejména potřebou reformy autorského práva a jeho harmonizací na území Evroské unie. V práci je proveden rozbor jednotlivých klíčových institutů souvisejících s překládaným balíčkem směrnic a nařízení a analýza vybraných problémů souvisejících s autorskoprávní ochranou na jednotném digitálním trhu EU. Závěr práce shrnuje postupy EU v dosažení jednotného digitálního trhu, přínos předkládaného autorskoprávního balíčku a některá doporučení de lege ferenda.

Abstract:

This diploma thesis deals with the legal aspects of the European Council submitted to the Reformed Copyright Act of 14 September 2016, in particular the need for the reform of copyright and its harmonization in the territory of the European Union. The work analyzes individual key points related to the presented directives and regulations and analyzes selected issues related to copyright protection in the single digital EU market. The paper summarizes the EU's approaches to achieving a digital single market, the contribution of the proposed copyright legislation and some de lege ferenda recommendations.
