Expert opinion from the point of view of the case law of the Supreme Administrative Court

Abstract:

Práce se zabývá právní úpravou znaleckého posudku a znalecké činnosti s ním související se zaměřením na užití znaleckého posudku jako prostředku dokazování ve správním řízení. Poukazuje na její nedostatky a upozorňuje na změny, které nastanou s účinností nového zákona o znalcích, znaleckých kancelářích a znaleckých ústavech od 1. 1. 2021. Práce se také zabývá hermeneutickým výkladem sofistikovaně vybrané reprezentativní judikatury, která se zabývá problematikou znaleckého posudku ve správním řízení. Výsledky hermeneutické analýzy způsobu, jakým vysoké soudy odůvodňují svá rozhodnutí odhalily pět charakteristik (opor), které se objevují napříč řešenými oblastmi případů. Nejvíce zastoupenými oporami byly důraz na věcnou stránku a opora v obecnějších zásadách a vyšších právních principech. To ukazuje na odklon vysokých soudů od formalismu a udržování konzistence právního řádu oporami v obecnějších právních zásadách a principech.

Abstract:

The thesis deals with the legal regulation of expert opinion and expert activities related to it with a focus on the use of expert opinion as a means of evidence in administrative proceedings. It points out the shortcomings of this legal regulation and draws attention to the changes that will occur with the effectiveness of the new Act on Experts, Expert Offices and Expert Institutes from 1 January 2021. The thesis deals also with hermeneutical interpretation of sophisticated representative jurisprudence, dealing with issues of expert opinion in administrative proceedings. The results of a hermeneutical analysis of the way the high courts justify their decisions found the five characteristics (support) that appear across the case areas. The most prominent supports were the emphasis on the substantive aspect and the support in more general principles and higher legal principles. This points to the turning away of the high courts from formalism and the maintenance of the consistency of the legal order with the support of more general legal principles.
