Authorities Protecting Public Interest (Supreme Audit Office and Office of the Government Representation in Property Affairs)

Abstract:

Úkolem mé práce bylo vymezení dvou uvedených institucí v jejich souvislostech historických, z pohledu zahraničních obdobných institucí a hlavně z hlediska platných právních úprav. Pokusila jsem se o ucelený pohled na oba úřady. V první části mé práce jsem stručně charakterizovala pojem „veřejný zájem“. Vznik tohoto pojmu a jeho užití ve společnosti je v novodobé historii spjat se vznikem právního státu. V českém právním řádu je takovým okamžikem rok 1867, kdy byl přijat tzv. říjnový ústavní zákon. Ten ustanovoval subjektivní (občanská) práva jedince – jinými slovy vymezil prostor, kde byla občanu poskytnuta ochrana před zásahem státu. Zvláště specifická zkušenost, kterou si česká, resp. československá společnost prošla v období druhé poloviny minulého století (1945 – 1989), má vliv na vnímání obsahu tohoto pojmu v dnešní době. Přechod z doby, kdy veřejný zájem byl zájmem státním, do doby obnovených a ustavených demokratických principů, byl rychlý a domnívám se, že určitý proces adaptace a srozumění se s tímto právním institutem naší společnosti ještě nějakou dobu potrvá. V dalších částech této práce jsem se již podrobněji věnovala popisu obou uvedených institucí. Abych přiblížila činnost i cíle Nejvyššího kontrolního úřadu a Úřadu pro zastupování státu ve věcech majetkových, čerpala jsem konkrétní informace i ze zdrojů jimi zveřejňovanými (hlavně z výročních zpráv). Důvodem je mé přesvědčení, že i konkrétní informace mají při objasnění obsahu jejich činnosti svou váhu. Je na posouzení čtenáře, nakolik se mi podařilo přiblížit původnímu záměru stanovenému tématem práce

Abstract:

The theme of my bachelor’s thesis is „Government Authorities protecting the Public interest – Supreme Audit Office and Office of the Government Representation in Property Affairs. First, I tried to clear the mention of the legal term „public interest“. As I mentioned in the chapter 2 of these thesis, indeterminate concept of the public interest is possible to approach by several typical characters. The Supreme Audit Office is presented in following chapter 3. The first part of this chapter is focused on history of this institution on our territory. The compentency of the Office is described in following part. According to the act No. 166/1993, about the Supreme Audit Office, the main task of this independent institution consists in inspection and monitoring of state and government agents. Basic facts concerning the organization structure are mentioned next. The most extensive part of this chapter is approached to the Office activities. In addition to the inspection and control, the international cooperation with foreign institutions is mentioned here. The Office of the Government Representation in Property Affairs is the theme of the chapter 4. For closer approximation, I mentioned several cases of similar foreign institutions at the beginning of this chapter. The parts which treat of competency of this institution are following then, namely questions of legal representation and its forms (exclusive representation, direct representation, subsidiary participation, representation of municipalities) and processing of legal approaches. Next part is adressed to management of state property – I tried to affect fundamental legal posibilities which are allowed in accordance with statutory rules. The question of financing and audit of the Office is mentioned in the end of this chapter.
