The Protection of a Human Genome from the view of the Medical and Criminal Law

Abstract:

Práce je zaměřena na právní problematiku ochrany lidského genomu. V první části je vysvětlen samotný pojem lidský genom z pohledu genetiky a biologie. V hlavní části jsem se zaměřila na sjednocení aktuální platné legislativy medicínského a trestního práva, která se dotýká ochrany lidského genomu při vědeckém zkoumání a ve vybraných oblastech souvisejících s ochranou genetické informace a lidského života jako jsou: asistovaná reprodukce, náhradní mateřství,umělé přerušení těhotenství, genetické testování. Je zde i část, která se dotýká etiky související s výzkumem na embryonálních buňkách. V poslední části jsem své poznatky prohloubila, srovnala a porovnala tuto právní problematiku ve Velké Británii a Spojených státech amerických. Poznatky z výzkumu lidského genomu stále rozšiřují a mění jeho právní ochranu.

Abstract:

This work focuses on legal problematics of protection of the human genome. The first part explains the actual concept of the human genome in terms of genetics and biology. In the main part I focused on aligning currently valid medical and criminal legislation from the viewpoint where legislation deals with protection of the human genome in scientific research and in selected areas related to protection of genetic information and human life such as: assisted reproductive technology, surrogacy, induced abortions, genetic testing. It also includes a section which touches upon ethics related to embryonic cell research. In the last part I broadened my findings, aligned and compared this legal problematics in Great Britain and the United States. Findings from research of the human genome are constantly expanding and changing legal protection of the genome.
